I strongly believe that following rules and maintaining good neighborly relationships are essential. Unfortunately, I have found myself entangled in a year-long battle with an HOA in Rockwall.
The HOA imposed a retroactive ban on leasing without any consideration for existing leases. As an investor community, it is crucial that we stand up for our rights and take this issue to the Supreme Court.
While I understand and respect the rules that were in place when purchasing a property, it is entirely different when the ban is imposed after leasing has already taken place. In my case, I had leased a property for 1.5 years before the board began rallying votes to ban leasing.
To fight for our rights, I have sought legal representation from Pratt Aycock. Together, we aim to establish a precedent that protects all Texas landlords from the power of an HOA to force the sale of a home.

It is important to note that state law provides authority in cases like ours, where an HOA changes the rules after the property has been purchased. State law prohibits the exercise of discretionary authority by a property owners' association if it is found to be arbitrary, capricious, or discriminatory.
