Pool Mobility Lift for Claire

Aqua therapy provides innumerable physical and emotional benefits in managing progressive FSHD muscular dystrophy . I know, I live with this rare disease. And the pool is my happy place, enabling me to move, breathe and even speak with greatest ease.

Help me make a safe splash

To safely get in and out of my neighborhood pool a portable pool mobility lift is now necessary (see video below). And after months of work a portable Aqua Creek Patriot Pool Lift has finally been approved for my purchase* by the Encore at Grayhawk HOA Board (all thanks to vocal neighbors, 101 Mobility, and most especially the Arizona Center for Disability Law).

Why is a mobility lift not mandatory at community pools, including multifamily complexes?

Good question. *A 1990 FHA law states: "There is no requirement for a lift into or out of a pool in private market housing [which includes in gated communities and complexes comprised of apartments, townhouses, and/or homes, like the one my husband and I reside as year round renters ]. The disabled person will have to finance and install a lift of their own as a modification under the Fair Housing Act (42 USC 3604(f)(3)(A)) if they want one for a particular pool."

Because of this law, multifamily developments such as Encore at Grayhawk are not required to install a pool lift; but they are required to approve a request for "reasonable accommodation" in which a person who is differently abled can purchase one on their own accord. 

Working on a higher level 

Campaign financing for equipment that ensures safe and equal access to community pools should not be necessary. The above FHA law is discriminatory and should be changed. So, in addition to the work of this private campaign, I am actively working on a petition that requires a pool mobility lift at all community pools nationwide.
