This is the story of Timothy Turner, a man who was wrongfully convicted for a crime he did not commit. Tim needs your help to fight for his freedom. On April 6, 2018 Tim was seated in a barber’s chair getting a haircut when a robber burst through the door, with a weapon, to rob the barber of what the barber claimed was over $40k worth of jewelry. Upon seeing the gun Tim dropped to the floor to try to get away and avoid being shot. As the gunman struggled with the barber to get his jewelry the gunman turned toward Tim, laying on the floor, and ordered him to get up and help him put the barber in a bathroom. According to the gunman he told Tim to get up and, as is seen in the video of the robbery, with the weapon near Tim’s face Tim was forced to help push the barber toward the bathroom. Faced with a choice of getting shot or complying with the gunman’s orders Tim did not act like a superhero and obeyed the gunman. Tim then saw an opening to escape when the gunman and the barber began an all-out fight. The gunman, after getting only two pieces of the barber’s jewelry, then fled and was not apprehended for almost two years. About one month after the robbery Tim was arrested and charged with several counts of robbery, assault and possession of a weapon. All based upon the statement of the barber who claimed that he saw Tim sending an I-Message shortly before the gunman burst in. Tim’s nightmare began. Tim went on trial, while the gunman was still “in the wind”. The prosecutors argued that Tim and the gunman had planned the robbery together. The barber claimed that Tim had set him up.
Unfortunately, Tim was found guilty of three counts of robbery, based upon the testimony of the barber. Tim was sentenced to 12 years in prison and began serving his sentence at one of the worst prisons in New York State, for crimes he did not commit. The jury never got to hear from the actual gunman because he could not be found. When the gunman was finally captured he came before the Court and when he saw that Tim was charged as his co-defendant he asked his attorney why he had a co-defendant when he was the one who committed the robbery with a gun. The prosecutor, incredibly, offered the gunman a plea bargain to Robbery in the Second Degree with seven years in prison, where he is currently serving his time. The gunman got less time in prison than Tim got after going to trial because he is innocent. Tim’s wife, the mother of his children, then found a criminal defense attorney on Staten Island and scraped together enough money to hire this attorney to prepare and argue an Appeal of Tim’s conviction. When the attorney began reading through the case file he began questioning how Tim could have been convicted when the only evidence against Tim was “smoke and mirrors” put forth by the prosecutors. Then the attorney contacted the attorney for the gunman and obtained a copy of his plea minutes. It was then that it was learned that the gunman had sent an Affidavit to his family in which he stated clearly that Tim was innocent, that he, the gunman, acted alone and that he wanted to tell the Court that Tim is innocent. Tim’s attorney then contacted the gunman to be sure that the he was really willing to testify to what he had written. The gunman then sent a new Affidavit to Tim’s attorney. With this “new” affidavit Tim’s attorney, Gary R. DeFilippo, Esq., made a post-conviction Motion to the trial court on the grounds of new evidence, the Affidavit of the gunman asking the trial court to hold a hearing so that the gunman could testify about the robbery, and Tim’s innocence, and to get the Court to vacate Tim’s conviction.
The Trial Court agreed with Mr. DeFilippo and granted Tim a hearing on this “new evidence” to permit the gunman to testify, in person, before the Court. At the hearing the gunman testified that he acted alone and recounted what he said during the robbery that could not be heard because the video had no audio. On direct examination, by Mr. DeFilippo, the gunman testified he was coming forward to testify that Tim was not his co-defendant and that he, the gunman, did not know Tim nor had he ever had any prior contact with Tim was because he wanted to do the “right thing”. When asked if he could receive an I-Message on his cellphone he responded that he had an android phone, a Samsung, and could not receive I-Messages. The prosecutor’s argument, based on the statement of the barber that he saw Tim I-messaging just before the gunman burst in to rob him, was shown to be false. Tim Turner could not have sent an I-Message to the gunman because the gunman did not have an I-Phone. There was no evidence connecting Tim Turner to the gunman. The gunman also testified that he only got two pieces of the barber’s jewelry, and the barber testified, at Tim’s trial, that four pieces of his jewelry were taken by the gunman. In short, without hearing from the actual robber the jury believed that Tim Turner was the gunman’s accomplice. After the Hearing the Judge then ruled that the jury may have reached a verdict more favorable to Tim if the actual robber had been available to testify at Tim’s trial. In other words, Not Guilty.
The trial Court then did what a trial court rarely ever does, the Judge vacated Tim’s conviction and sentence, and a “New” trial has been ordered. In other words, Tim’s attorney made a Unicorn appear. The prosecutor has filed an Appeal to overturn the trial court’s Decision and Order, and a motion was also filed to get the new trial delayed until the Appeal is determined. Mr. DeFilippo defeated that Motion, and the new trial will begin on September 25.

Tim asks you to view the story on this page (see above) Tim is a family man and prior to this wrongful conviction he was embarking on a new venture as a Professional, Natural Bodybuilder with a very lucrative deal with Musclemania, a leader in natural fitness competitions and training. He was about to sign a six-figure contract but all of that was lost when he was convicted. Tim lost everything and now that he is out of prison, and home with his family, he is unable to find work because of the upcoming re-trial. And while his wife was able to scrape up enough money to pay for Mr. DeFilippo’s representation to get his conviction vacated, together they are struggling to find the money to pay Mr. DeFilippo, and his co-counsel to represent Tim at the new trial, and in opposition to the District Attorney’s Appeal.
