Governor Greg Abbott and local county judges have violated the God-given, unalienable constitutional rights of Texans by mandating lockdowns and closing businesses and church services. Article 1, Section 28 of the Texas Constitution reads as follows, “No power of suspending laws in this State shall be exercised except by the Legislature.” Governor Abbott and many local Texas politicians have acted like tin-pot dictators with their lockdown and social distancing orders. This has led to the loss of over 2 million jobs in Texas. This adversely affects 2 million families representing at least 8 million individuals.  There is also tremendous collateral damage to the economic and physical well-being of all Texans. Over a million businesses are on the verge of bankruptcy in Texas. It is sheer idiocy to destroy the lives of millions of Texans and Texas businesses in hopes of preventing the spread of a flu-like virus that affects less than 1 out of 1,000 Texans.

 

What is really pathetic about this whole situation is that a Republican Governor, Greg Abbott, violated the Texas Constitution and the U.S. Constitution, just like the socialist, communist democrat governors in blue states. But you say, “Dr. Hotze, Governor Abbott is slowly letting us get back to work.” Governor Abbott never had the authority to shut down our businesses and church services to begin with.  Abbott has been the Attorney General of Texas, and a member of the Texas Supreme Court. He knows that his actions were unconstitutional.

 

I have had some mamsy-pamsy Christians tell me, “but the Bible tells us to obey governing authorities.” The governing authority in Texas is the Texas Constitution and the U.S. Constitution. If an elected Texas official violates either constitution, then his executive order has no authority and must be opposed.

 

The purpose of civil government is not to protect our health, but to protect our rights. Abbott has failed to do that, and that is why I am opposing him and asking you to demonstrate the courage of your convictions and join me as a plaintiff in this lawsuit.

 

Because he has violated our constitutional rights, I have filed a lawsuit, Hotze et. al. v Abbott, asking the court to strike down Abbott’s unconstitutional executive orders. This case has been filed in state district court in Travis County. There are over 200 plaintiffs who have joined me in this lawsuit.
