On what I thought was a normal morning in May, I woke up to my baby crying. I jumped out of bed to go get her and instantly froze as I realized I was standing in several inches of water. As we frantically tried to find the source of the flooding, we discovered that water had been flowing out of a cement diversion box down the road and into our basement throughout the entire night. We quickly learned that a pipeline serving several subdivisions and the local school district had backed up and flooded due to debris in the line.
Our restoration company responded quickly and started working to salvage as much as possible, but even with their fast action we still experienced over $70,000 in damage to our home and personal belongings.
Our home insurance won’t cover any of these damages because the water came from outside our home. We have been working with the City of Kimberly, Twin Falls Canal Company, the Kimberly School District, and the subdivisions to try to get this resolved, but so far all of our efforts have been denied. No one has stepped up to take accountability for the harm that’s come to our home and our family.
Because trying to resolve this on our own has gone nowhere, we had to hire an attorney to advocate for us—to stand up for our family when no one else would. We and our attorney had hoped things would be resolved quickly, but this has dragged on far longer than we anticipated. The costs to fight for our home and our family continue to grow each day, making it so much harder to continue seeking justice in this nightmare. If we can’t come to an agreement with any of the insurers, we will need to shoulder the costs of paying the restoration company while also taking on further costs to pursue our losses through litigation.
The worst part, though, is that we’ve been impacted far beyond the financial toll:
- We’ve drained our savings—including the funds we’d set aside for infertility treatment.
- We’re under significant stress that’s now affecting our physical and mental health.
- We’ve had to take time off work to attend meetings, coordinate repairs, and care for our distressed child who has had her routine and sense of security upended
- We’ve put off needed car repairs and are sharing a vehicle
- We’ve lost our sense of safety and security in our home and community.
- We’ve had to ask family and friends for help just to get by.
- We’re facing major impacts to our credit and long-term financial security—and we’re terrified of what happens if we’re forced to go further into debt just to keep our home.
We’re overwhelmed, exhausted, and scared. We have really struggled putting this out publicly and feel terrible asking, but we need help. We’ve set an initial goal of $5,000 to help with immediate legal costs. If things move toward litigation this fall, we may need to increase the goal to reflect those additional expenses—we’ll keep you updated every step of the way. If we receive more than we need for legal costs, any extra will go toward replacing what we’ve lost or covering interest if we need to take out loans to pay the restoration company.
