My story is every mother's worst nightmare. My daughter (step-daughter)was removed from our care on Feb. 2105, by CPS. Not because of abuse or neglect, but because of a 10 year old warrant, that was issued when she was in the care of her biological mother, at the age of 1 month. A warrant, we had no ideal about. My daughter is now 10 years old. She was picked up from school on a Friday late afternoon and all we received was a voicemail, that she was detained, with no further information. We had to go all weekend with the agony of how she was feeling and not knowing where our child was and if she was safe.
Monday morning arrives, and there was no doubt in my mind, all weekend, that I would walk into the CPS office and that they would know this is a mistake and we would leave the office with our child. Why wouldn't they? For 10 years, she's been in the care of her biological father and stepmother. She's healthy,happy and lives a good life. And more importantly, this CPS system is designed to do " what's in the best interest of the child" But, that was not the case. What we received was that this is "legal mess" and we would have to appear in court. All along our child is suffering.
It has been three weeks and our daughter is still not home. And there is no reason, as to why. Not one person, can give me a clear reason of why after 10 years, these people would come into our lives and take her away, with no regard of the emotional damage they are causing her or the harm that could occur by placing her with strangers.
I have spoken with several attorneys, and all of them have stated to me, that everything about this case has been illegal. She should have never been removed, a 10 year old warrant, is not a good enough reason to remove a child, that was not in danger. And we recently just learned, that when the CPS officials went to the school to pick her up, that they called for a police escort, which I assume is their practice. But, in the officers report, he stated " he was not going to remove the child because of an old warrant" and the child was not in danger", the officer proceeded to call his supervisory Sargent, who also agreed that child should not be removed, but the CPS worker, still went into the school and removed her. According to the attorneys, CPS overreached their power of jurisdiction .
I am a good parent, I breathe and live for my children. But, I can't fought this battle, by myself. Fighting against a system that makes no sense, especially in our case, is not easy. A system that won't admitt that they are wrong and give us our daughter back.
I am asking for help for attorney fees, to hire an attorney that specifically deals with fighting CPS cases. Please, help me our daughter home, to where she is safe and loved.
