My battle for custody of my children has recently taken a positive turn! On Tuesday, March 15, 2016, I appeared before a panel of judges (In Banc Review) and appealed the Court's ruling of giving primary custody of the children to my soon-to-be-ex wife. My appeal is based on the fact that the judge was biased, that many court rules were broken and there were many glaring abuses of discretion on the Judge's part during the course of the trial.
If the points I raised on Tuesday were invalid, then the Court would have ruled to keep the divorce judgment in full force and effect and the divorce and all of the custody injustices would have became permanent. But the points I have raised are definite grounds for this appeal and they "simply" want a copy of the transcript of the divorce trial. The trial was 3 days and is going to cost me $3,000! I have represented myself (pro se) for the entire journey of the divorce, because I have not had the money even for a retainer for a lawyer! So I am reaching out to anyone who may be in a position to help me financially so I can get my kids back.
I have not been accused of hurting or abusing my children at all in any of the court proceedings. I told my wife early on in our separation that I wanted to have the kids 50% of the time. I was actually responsible for watching the kids 4 - 7 nights a week because my wife left for work right around the time the kids got off the school bus (ages 7, 9 & 11) My wife refused to agree to 50/50 custody for ONE reason. She said that she needed the kids for the majority of the time because the State of Maryland's calculation for child support was based on how much time the kids were with each parent. She told me that she needed primary custody of the kids because she could not afford to live without the amount of child support she would get if I had that kind of joint custody. I offered her 60% of my total income and agreed to sign something that would guarantee her that amount of money regardless of how much time each of us would spend with the kids. She refused because she was worried that she might not get the money she was so determined to get.
I simply want as much time with them as possible, to love them and to raise them in a healthy home.
The overwhelming majority of court rulings in the State of Maryland are to let the mom have the kids and let the dad have the kids every other weekend, regardless of who is the better parent or what the status quo was while the parties were together. That is what the judge ruled in the divorce trial. However, if I can successfully overturn the ruling, then the bias in favor of the mother can also be far more scrutinized! The lead judge in the current panel has a reputation for ruling in favor of deserving fathers!
I have opened up a GoFundMe account online where I will be receiving donations strictly for this cause. The need is immediate and urgent. I must have the entire amount by March 28, 2016. Even if you can only afford $5 or $10 dollars, it will help if a large number of people step forward with concerted action! But if you can afford $1,000, then the goal will be reached much more quickly. The immediate goal is $3,000. If you could ***share my story*** to your friends on your social media of choice! Perhaps a few more people will be reached who know the pain of losing their kids and will be moved to give. Who knows?
Loans are also welcomed! If I have to borrow $3,000 to pay for the transcript, then I plan to pay those loans back proportionately at 10% of the loan every month over the next 10 months.
