Hello, My name is Tyler a fellow resident of the city of Manassas Park.
I am here today to ask not just our local community but anyone that can help support Mike and Lysa Smith with their ongoing battle with the city of Manassas Park.
Mike and Lysa have been going through constant battles with the city of Manassas Park since they purchased their first home together in 2020.
I can only describe this situation as "David vs Goliath".
I am creating this go fund me account to help them with legal fees as this case is not just a fight for the Smiths, but ALL residents of Manassas park and cities alike.
If the city wins in court, this will essentially give the city a pass on a blatant mishandling on their end (Described below) and will allow them to continue to post violations and go after residents in like situations that should have been properly handled YEARS ago.
When Mike and Lysa purchased their home in 2020, they were under the impression that the home was in good standing with the city as the home had a clear title and no violations brought to their attention during the time of purchase (and had no reason to believe so).
Lets now fast track to 2023...
Mike and Lysa's home had a newer garage and driveway installed (With permits pulled) by the previous owner in 2017.
After a 6+ YEAR span the city has just now decided to post a violation of code (maximum driveway width) to his door and charge $1000 per day until the violation is resolved.
This "correction" would entail that the Smiths would need to pay out of pocket to have the driveway modified to meet the city's code.
If the city had handled this process properly during the initial permit and inspection process this may have been corrected before they purchased their home.
The city essentially did not perform a proper post inspection to visually ensure all conditions were met for the permit when the previous owner installed the driveway.
This is a violation of the city’s own documented policy, which states that “The apron or curb cut needs to be inspected before the concrete is poured and after it is installed.” And took 6+ years for them to take any sort of action with a NEW owner of the home.
Mike and Lysa have tried to find a compromise with the city and applied for an appeal to the violation given the circumstances (which was Denied last night 10-26-23) along with a request for variance due to their specific situation (Which was also Denied last night 10-26-23).
It is in my opinion as a fellow resident of Manassas Park, the city has made it clear that they do not care about nor want to work with its residents for a mess the city created years ago.
Mike and Lysa fell in love with their home and became rolemodel citizens within by volunteering for trash clean up events, attending city council meetings, welcoming new neighbors to the community (Including myself) and keeping their home in excellent condition.
I hope those that read this can help Mike and Lysa by donating towards their growing legal fees, or at the very least share this to others as I feel their case could resonate to many in cities, towns or counties alike.
