Force the PLCB Allow Direct Delivery of SO Wine

I am currently filing an injunction for something known as a writ of mandamus against the PLCB. That would force the PLCB into compliance with Act 39, meaning they would need to allow distributors to directly deliver Special Order wine.

For licensees currently selling wine-to-go, but unable to restock your selections because the PLCB is closed, why this is a good thing should be obvious… But even if you are a restaurant that is currently shut down or cannot yet sell wine-to-go, this is also something that you should want for your future. For all wine delivered directly to you, the PLCB cannot assess their handling fee, which would result in a reduction of ~$1.75 off your cost of every bottle you have it delivered directly. And, it goes without saying, it is delivered directly to you! No trips to the PLCB store with parking tickets, no paying a third party service to pick up, no unneeded extra contact with PLCB employees that might be a health hazard during this time, easier fixing of problems/returns if/when they do happen, and more. The long term implications on profitability to all of your beverage programs could be significant, even once the PLCB stores are back open and SOs are flowing normally.

For distributors, you can use the ability to deliver directly essentially as a volume discount. For example, we will offer direct delivery (and thus, a discount of $1.75 per bottle) only if an account is ordering 5cs at once. That way, we can entice larger sales volumes while still making the same amount per case on our end, which can help offset any potential extra costs associated with direct delivery. You can decide the parameters for when direct delivery is offered to make sure it monetarily makes sense for all parties involved.

For consumers, distributors will now be able to deliver Special Order products directly to you, dramatically improving your available choices in the state and making it easier to purchase SO products.

And for all of this, we will still be returning the same or more to the state General Fund (since the 18% Emergency Tax will still need to be assessed), and we are not endangering current PLCB jobs; in fact, we would be freeing them up to do more of the work they were hired to do, instead of having to spend so much time processing SOs.

To be clear, none of this requires any new legislation to be passed; we will simply be forcing the PLCB to comply with the existing statute already signed into law. The PLCB has been in violation of this law since June 1, 2017, and it is now time we take action. 

It is not lost on me that we are currently in the middle of a pandemic with record unemployment and I am here asking for money. It weighs on me very heavily, and if you are unable to give anything at the moment, I totally understand.
