Legal Representation at David v Goliath Employment Tribunal

Hi, my name is Marisol and I am seeking financial assistance to find justice for myself and my former colleagues. I can't go into too much detail here because I am in the middle of a legal case not yet resolved. I can say that I am claiming automatic unfair dismissal for making protected disclosures related to workplace safety, unlawful wage deductions and irregular itemisations of pay, injury to feelings, detriment, bullying and victimisation. My employment tribunal claim also includes the absence of industrial injury policies, infringement of general data protection regulations, and improper handling of my grievances through not following due process according to company or Acas protocols, leading to a sham dismissal. I believe that adequate health and safety policies are not in place to protect employees. One week after I raised a health and safety grievance a colleague's near-fatal injury left her paralysed with severe brain injury. Three weeks later I was dismissed.

The issues during my employment started over two years ago. It is over a year since I submitted my case to the employment tribunal. To date I have been representing myself aka a “Litigant in Person”, though I have had both free legal and informal advice from charities and lawyer friends of friends. I have also sought some professional legal advice to consolidate my claims. While still in employment, a senior trade union representative supported me through attending my grievance meetings with HR, however the union is not representing me. I have been in touch with Advocate, a pro bono charity, but they are unable to guarantee categorically that they can represent any Claimant as it depends on timeframes, etc.

I have now come to realise that unfortunately it takes more than hard work, good intentions, or a desire to expose unethical practices to fight big corporate and their legal teams. The increasing stress as the case draws out over time has taken a severe toll on my mental health and my spirit to the point that I have almost abandoned the case to preserve my sanity.

I have already consulted a solicitor for their professional advice and guidance which has cost over £5,000. This has put me in further debt.

Due to your overwhelming generosity you have helped me pursue this case further through engaging a barrister to help me with the upcoming Preliminary Hearing in November. His costs for the three hour hearing and preparing certain case documents are £1,500. This has been raised! Thank you with all my heart.

The funds will be used to pay for further legal representation, stage by stage, to put myself in the best position to fight my case and hopefully also improve working conditions for present and future employees at my former employer.

For anyone who knows me personally I am a deeply sensitive person whose intention is to do the best I can for the benefit of all beings. Truth, integrity, discernment, and right action are integral core values and this is why it is important to me to bring these injustices to light.
