Join the Legal Challenge to the Mayor of London’s proposed changes to the Congestion Charge Scheme from 22 June 2020

Hello Friends,

My name is Shaheen, and together with my firm Black Antelope Law, we are seeking to bring a legal challenge against the Mayor of London for his failure to carry out a proper consultation regarding his proposed changes to the Congestion Charge Scheme post COVID-19 that will affect many local residents, individuals and businesses going into work from 22 June 2020 onwards. The Mayor of London in a Press Release of 15 May 2020 proposed that the Congestion Charge would be reinstated on 18 May 2020 following the COVID-19 pandemic where it was initially suspended on 20 March 2020 and will increase to £15 from 22 June 2020 and the hours of operation extended to 7am to 10pm, seven days a week. The Mayor of London also plans to temporarily close the residents’ discount to new applications and has failed to consider the negative impact this will have on everyone and every industry in London, especially in the midst of the COVID-19 pandemic.

We believe that the Mayor of London has acted unlawfully by overriding his duty as a public body to act fairly in the exercise of his function, namely his failure to engage in a formal consultation period with those affected that is adequate and fair as established in the case law. A flawed consultation process restricting the right to be heard is now a common ground for judicial review.

The timescale from announcing the proposals to the 22 June implementation date is woefully inadequate to consider the views of those affected in any structured consultation period, should the respondent have attempted to do so in the first place. It would be difficult to see how members of the public could express an intelligent view on the proposed scheme, so as to participate in a meaningful way in the decision-making process.'

How much are we raising and why?

Our first step is to raise a Letter Before Action which sets out in detail our case and will give the Mayor Of London a short period in which to respond. Once the deadline has passed, we will review his response with the view of providing an additional rebuttal or to commence the Judicial review process.

Initially, we need to raise money to perform the initial work in this case (including getting opinions from Counsel) but we will then need to go on to raise more should we intend to take this case through to completion at Court and truly hold the Mayor of London to account. All funds will be transferred directly to our legal team to fund the action. We will, of course, keep you informed of our progress throughout. 

Any funds not spent by way of the above will be donated to the Maternal Aid Association, a registered charity (in England no. 1166021) dedicated to providing medicine, resources and education to mothers and young women in developing countries, in hopes of improving maternal healthcare and empowering the next generation.
