I'm raising this fund for a lawyer retainer for my brother Jathan and also, for his bail if there ends up being any leftover. He got in some trouble recently for a dui and since he was on probation they are trying to send him to prison and also stick him with another felony. His first charge came two weeks after he turned 18, felony assault on a peace officer and felony intimidation because he was shutting the door of my apartment on them. While he was going thru that trial, Jathan was heavily suffering with his mental health. He was in a psychosis, in and out of hospitals and had to sit in jail as well like that. When Jathan is in a psychosis, he often needs constant direction and supervision. He was not of sound mind, and was still basically a child. The felony charges came from a plea bargain he was pushed into during that time, which drastically hurt his already trying life.
Jathan has been on his own since he was 15, when our mother died. Although he was homeless, he graduated high-school with only the clothes on his back.. He's been homeless for the majority of this time, until he came to me in August. We got him therapy, medication, & he started working again, 2 jobs and got his own apartment. Jathan flourishes with routine and family. He is now only 22 years old and does not deserve to be in prison. When he got this recent dui, they gave him another felony intimidation for badmouthing the police. We all know how the system in place is built to keep Native Americans in and out of prisons, in debt to the courts. Jathan is one of many native Americans in Montana who have made regretful decisions at a young age and put into a revolving door of jail and debt, he deserves a chance at living his life. My brother is a good person, he's loving and full of potential. I've always seen his potential, I am proud of who my brother is and I do not want to see him sit in prison over a dui. A dui in Montana is usually 3 days in jail, $1400 in fines and a $400 class, not prison. There are other options for him, but he will not recieve any treatment in jail. The only way to help him and get his story heard is working with a lawyer. Because it's technically 2 cases, it's an expensive retainer. Please share this and donate anything you can. Every dollar counts, this means the world to me. His story deserves to he heard and he deserves the chance to prove himself. I know he will but we need this retainer to get anywhere. In addition to lawyer and court costs, Jathan will be losing his housing and we will be responsible for taking care of his belongings and future housing.
