Thank you for your generosity and continued support through donations and prayers. This litigation has been going on for 4 years now and Katie and her girls still need your help.
She is in a temporary phase since the mistrial was granted in March 2020. ( The court found that an inappropriate relationship may have existed between the Amicus and opposing counsel during the jury trial). Her team has filed an emergancy motion, enforcements and waiting to get in and address this urgent situation. Covid has also brought delays and funds are continually needed for legal cost.
Please continue to pray for the girls as they are still blocked from their mother on the days when its not her court ordered visits. The one with Autism is still struggling with not having her medically necessary therapies available to support her with her deficits.
On May 12, 2020 Katie sought the assistant of the court with a Habeous Corpus and the Sheriff was able to retrieve the girls after being hidden for over two months from her. She is now able to resume the Family Court's minimum "Standard Possession," which is still far from optimal for the girls' health & well-being.

On February 17, 2020 Katie McCarty asked the Court to hear her new evidence regarding misconduct during the jury trial in June 2019. This bias they saw between the Amicus Attorney, and the Opposing Counsel, clearly had a detrimental effect on the jury's decision last year.
On March 25, 2020 the Judge granted a Mistrial in Part (for Conservatorship, Possession and Access.)
On April 3, 2020 this Order was signed: “After considering all the evidence and arguments of counsel, the court GRANTS the motion in PART. It is therefore ordered in the interest of justice that the jury verdict is set aside and a new trial is granted as to the parenting plan (conservatorship, possession and access only).”
On April 5, Opposing Counsel responded with a motion filed to the 14th Court of Appeals for a Stay of Proceedings.
On April 6, Opposing Counsel filed a 2nd motion to Court of Appeals, a Petition for a Writ of Mandamus
On April 9, 2020, The 14th Court of Appeals DENIED BOTH MOTIONS.
On April 9, 2020, Opposing Counsel filed a 2nd Writ of Mandamus to the 14th Court of Appeals.
Again, The lower courts ruling to set aside the jury verdict is a huge step forward in the quest for Justice for Katie’s young daughters! But justice comes with a cost. This family is in a financial crisis! And we are broken hearted. We are devastated.
We need to raise funds to cover legal help to bring this mom's two youngest daughters home to their sister and remain with her full time in Texas. We need funds to help repay legal loans. Her little girls were abruptly taken from her grasp in early August by a jury custody trial. The jury got it wrong!
Here's how and why: She was outgunned and out lawyered because she was not allowed equal legal representation! She was locked out of her rightful financial assets by her spouse when she first spoke out about the domestic violence, which unfairly put her at an disadvantage. We have heard from credible sources that there is misconduct during the jury trial by officers of the court. The mom was also forced into a jury trial . There is evidence that was suppressed. The Amicus was strangely against her, never doing the proper interveiws of witnesses and research prior to the jury trial. Witneses saw her unprofessional behavior in the hallways of the courthouse. The Amicus not ever interviewing any of the medical professional who treated the one child for her Autism .
We must now HELP them go forward to fix it.
Now since the jury flipped custody to the girls father, he has sent them to his mother temporary and he lives in the middle east, they no longer have regular access to their own familiar home, friends and family. Mom has been blocked from frequent contact and wellbeing. The girl's older sister is very bonded with them. She is a sophomore in college, on the Dean's list and on track for a bachelors in nursing. The little girls are also very bonded with their sister.
Its heart wrenching to see this stress and confusion in the little girls. One of her girls has a disability that needs professional therapy each week. She has been in therapy for three years prior and has made amazing progress. She has now missed several months of that care! She has been pulled from everyone of her established medical treating professionals since she was three. She has high functioning Autism. She struggles with transitions and sensory issues. She is struggling on why she can't see her mom, big sister, and neighborhood girlfriends often. Her meltdowns and speech has regressed.
Mom has been the ONLY parent in their lives since they were born. Their father has only seen them a few times since 2014. He has now chosen to live in the Middle East where visits and their rights as a parent or female would be impossible. It's an opportunity for them to be hidden, or difficult for legal rights to be exercised by the US court system. There are safety concerns for American single females living in the Middle East.
The legal struggle started when her spouse filed for divorce and blocked her access from community assets, credit cards, and access to any loans during the 3 year divorce. During the nine day jury trial the custody decision was SO wrongly decided in his favor! The lies were not refuted because she did not have the financial resources to hire attorneys in adequate time.
The Amicus was strangely against her, never doing the proper research prior to the jury trial. Not ever interviewing the medical professional. .
We the family and friends are shocked and distraught! We are ALL suffering. These precious girls were yanked from the ONLY life they have known: their older sister, friends, family, church, toys, school, and neighborhood. NO time for acclimation to different caregivers or possibly soon taken to a far off country.
Even with Amicus in place, there's been TOTAL disregard for their best interest, and parental rights to let her fully see them or talk to them regularly. There is total disregard for the medical treatment ordered by the daughter's pediatricians. The Amicus abruptly got off the case .
Mom has no criminal record, no CPS claim. Always had her daughters with her. She raised them with care in her Christian faith, and in their school community since birth. In the past they were forced to go on food stamps.
Her legal team is prepared to push ahead to reverse or modify this unjust decision. They have solid grounds to be successful. However funds are needed to maneuver through this legal system, and to pay back the accumulated legal costs.
