Hi ! My name is Miguel Avila , I am an Indigenous Grassroots Activist from Peru, my activism cover issues of Poverty, Food Insecurity Housing , Police Accountability and Human Rights in Toronto.
I have lived at 220 Oak Street since 2010 after being homeless in the streets
I became the Tenant Rep in 2011 and never had a problem with the Building Management or the Residents
I have been the Tenant Representative of 220 Oak Street, for 14 years, and under my Leadership My Building have enjoyed improvements such as locating additional CCTV cameras, from the Parking Garage to the 28th Floor, on every floor, a New GYM facility, A Doggie Park , an E-bike Locker Space and other mayor amenities part of a $30 million Tower Renewal Project I advocated for at the City and at the TCHC board level.
I have acted with integrity , decency and honesty throughout this 14 years.
In June and July 2023 our building was shaken up by violent and loud noises coming from a Unit on the 9th Floor of my Building.
We never had this problem before I collected 35 Signatures addressing the Noises to the Local Hub Management of 220 Oak Street, demanding action by the Landlord.
Well that Petition did no made an impact at all, and my health was getting worse each night that wasn’t able to sleep.
I am a Man with Mental and Physical Disabilities and the lack of sleep that I was experiencing in 2023 made me do something that is not my nature : Violent…
Yes I kicked the door of the 9th. Floor Unit where the source of the noises was coming from in view that no one will believe me and the inaction of upper management to understand that 35 RESIDENTS , that our sleep and mental health were affected by the Loud Noises that keep us awake every night. It is not me who caused the incident I lost it , I snapped because I have been enduring so much pain I am not a super human
The Landlord did not asked me to pay for the damage door or make a payment plan instead initiated the eviction process at the Landlord and Tenant Tribunal
I have been issued this past Tuesday November 19th 2024 with an INVOICE for the amount of $380 dollars to cover the cost of the door replacement from the resident of the 9th floor from July 04 2023 the day EIGHT (8) members of the Community Safety Unit (CSU) arrested me and laid Criminal Charges against me
I fought in court the charges and finally in October 2024 those charges were dropped by the Crown.
Intentionally the Invoice had for due payment.. incredible “ August 14 2024 “. so I am in arrears because the Landlord have not received payment yet. I am sure their legal department will be asking the court for a fast date in court to evict me.
I live on a fixed income ( ODSP) I wrote my worker if I could have this amount covered by the Housing Stabilization Fund. Unfortunately that request was denied
I don’t have money to cover the cost of the Invoice and if you are kind enough to pitch in a dollar or two towards my Go Fund Me this will assist me in paying the arrears amount so when attending my next Landlord.d and Tenant Board hearing there won’t be a legal reason for the LTB to evict me.
Also I want to compensate the Law Student that is helping me out wth ,My case, Young Professionals after graduation have to pay back the OSAP $$ back.. and these is really hard so many worries, on top of that expensive rent and food….and if I can get enough donations I will contribute towards paying some of the OSAP Debt so my Young Friend can focus on paying the rent and food as he advances his law career..
Sincerely
Miguel
