Wells Fargo: Reverse the illegal sale of my home to US Bank while processing a modification loan, also known as "dual tracking". US Bank: Withdraw the eviction notice. Evicting me leaves me home-less while husband battles cancer with only days to live.

My name is Florica Moldovan, and my life has been an uphill battle for the last 5 years, but in order to fully understand my story, I must rewind reels of time. In the summer of 1997 it was a joyous occasion when my husband Nick and I purchased our home. It was a meager 1000 sq feet with five of us in it, but it was ours. We began raising our then small children ( Nick, Nicole, and Jacob) in this house. My husband took the small home we purchased and spent the next 10 years working nights and weekends making this into the home of our dreams. His background working in carpentry, painting, and many other aspects of home construction made him the perfect man for the job. As the children grew older, and I became able to pursue a part time career as a hair stylist, he began again. Nick built me a 500 square foot salon in our back yard so I wouldn't have to leave the children very often and could still pursue my passions. This is the type of man He is, putting his family's needs above his own. Early in 2009, my husband finished remodeling our home to include an assisted living facility on one side of the house. We decided to do this so Nick could eventually spend less time working outside of the home and spend more time with our children before they were all grown up. In December of 2009 our lives took an unexpected turn. Nick was diagnosed with stage 3 colon cancer. Our lives had hit a stand still. He began chemotherapy immediately and quickly became unable to work and provide for our family. Though we were able to contract one client in our in home assisted living facility, the bills began to pile up and we were far beyond making ends meet. In early 2010 we were now late on our mortgage and began seeking a loan modification from our lender like many other Americans affected by the Great Recession. Wells Fargo met our request with a denial letter saying we did not qualify for hardship assistance to modify the terms of our loan. In early 2011, I was referred to the Neighborhood Assistance Corporation of America (NACA) and told that they may be able to help me keep my home. However, after many months of correspondence we were eventually told they could not help us either. In the August of 2012, we decided to hire a lawyer to proceed with a Chapter 13 bankruptcy which prevented the sale of the home. While under Chapter 13 bankruptcy, our monthly mortgage was $3,998 and with no other choice we were able to scrape by for 11 months. However, the next month one of my clients passed away and we were unable to make the next payment. Our shot at bankruptcy was over, so we again began lengthy loan modification talks. While we were again in lengthy modification talks, Wells Fargo sold our home to US Bank in August of 2014. This is known as dual tracking, and according to consumerfinance.gov in 2013 became illegal for banks to foreclose ones home while under loan modification. We were not alerted of the sale until February of 2015 when Wells Fargo sent a return check of 6 months mortgage we had been paying. The letter accompanying the check said they had no record of our loan and to stop sending them the money. Just last week we were served a 3-day eviction notice by the police and the bank. Not only is our home filled with irreplaceable memories being taken from us but also our livelihood providing assisted living. All of this time my husband has been battling the cancer and is currently hospitalized at UC Davis in Sacramento with pneumonia with no signs of improving. I haven't had the heart to tell him that we've been evicted and we're scrambling between family's homes as he lie, intubated yet barely breathing with only days to live. This home is our livelihood, its the house he built with his bare hands, and most importantly the place where countless memories my kids and I have with Nick. We are desperate to get our home back and hope our reaching out to our friends, and concerned citizens to petition these banks will rewind the sale of our home and give us an affordable payment.
