...a fact she would not discover until after his sudden death. That’s when she would find out that, during her cancer treatment, he also altered their estate planning documents to leave everything they had built together to his mistress. So began Kelly’s second fight.
Last year, Kelly lost the man who had been the center of her world for over 18 years, her husband and best friend Rick. The two had been preparing to celebrate the holidays, made ever more meaningful by the knowledge of how hard she had fought to survive both highly advanced and aggressive breast cancer and her newly diagnosed congestive heart failure caused by the chemotherapy. His death was unexpected and devastating to all who knew him. Kelly was left to wonder what there was to live for, as it was the life the two had planned for and pledged to each other that had kept her fighting so hard for two and a half years. They had promised each other to always be together and now he was gone.
Unfortunately, the pain was only just beginning.
Two days after Rick’s death, after a desperate search of the house for Rick’s will (it was suggested that it may be needed for the funeral home to prove Kelly’s authority in making funeral arrangements), Kelly called their lawyer in search of a copy of said will. The call she received back shocked us all. It was revealed that in 2016, mere days after holding Kelly’s hand during a round of chemotherapy, Rick had the lawyer draw up a new will naming his childhood “girlfriend” as the beneficiary. Stunned, but still unwilling to come to the inevitable conclusion that Rick had carried on an improper relationship with this woman, Kelly continued to honor Rick and plan the memorial he would have wished and allowed his friends and loved ones a chance to grieve. Days before the wake and memorial, however, it was discovered that in addition to naming this woman in the will, Rick had also removed Kelly as beneficiary of his life insurance, leaving this to his mistress – a married woman herself – as well.
In due time, a notebook Rick secretly kept detailing his affair with his mistress was also found, confirming all of Kelly’s worst thoughts and fears regarding this man in whom she had placed all of her trust. It was revealed in this notebook that Rick had begun an affair with the still-married woman shortly after Kelly was diagnosed with cancer, going so far as to meet her in a hotel to consummate their affair just days after Kelly’s mastectomy. Their brief affair ended when she realized Rick was never going to leave Kelly, unfortunately, it was Rick who died before he could fix the legal mess he had created.
Kelly is now truly once again in a battle for her life, and the life that she and Rick had built together, against his mistress, who feels that her off and on flirtation and short lived physical affair with the husband of another woman entitles her to the life that Kelly and Rick had built together. She is attempting to take it all by filing a photocopy of the will and trying to claim the life insurance policy that rightfully should go to his widow. Kelly has been permanently disabled by her illness, her body ravaged by both the cancer and the aggressive treatments used to save her life. Her ability to work has been compromised and even with her extremely expensive health insurance, her monthly prescription costs are astronomical. She has now also been forced to spend tens of thousands of dollars in legal fees in an effort to fight the mistress to preserve the business and life that she and Rick had built in their 18 years together.
