My name is Selena Herrera and I am a K1 Petitioner, meaning I have filed a fiancé visa for my fiancé, Sediq Sherzad, to enter the US so we can get married in the United States surrounded by family. It’s been one year since I submitted my application for a K1 visa.
The process of obtaining a visa is super hard and expensive alone, but mixed with a pandemic and travels bans, it has made this process much more difficult. I am trying to raise $2,500 to help cover expenses for a limited opportunity to get my case processed and Sediq an interview to try to be granted the visa!
These last few months a case called Milligan v. Pompeo has been in court arguing the legitimacy of not processing, interviewing, or issuing fiancé visas due to the Presidential Proclamation banning nationals or individuals currently residing in China, Iran, Brazil, Northern Ireland, UK, and the Schengen Zone (majority of Europe). Currently my fiancé resides in Greece which makes him banned according to this proclamation. Family is exempt from these proclamations, though fiancé’s have been categorized and treated as only tourists. Fiancés should be regarded as family and deserve to be exempt from this proclamation as well!
On November 19, Milligan v. Pompeo resulted in a victory for the lawyers and visa petitioners represented, where the judge saw the engaged couples as “star-crossed lovers tragically separated by a plague.” Since its victory, the State Department has decided to grant processing, interviewing, and issuing visas for only the plaintiffs named on the case, not the entire spectrum of fiancé visa petitioners which has left Sediq and I still waiting in limbo.
But now there is a window - the judge is allowing an addendum for more people’s names to be added so they, too, can be granted exemption and move forward with their cases! The fee is $2,000 to be represented. I’ve added $500 to cover any extra fees that may come along with the rushed process. As I only have until December 11 to make this goal, time is moving quickly and I'm praying Sediq and I can be represented by this case.
I have been waiting on this fiancé visa application for over one year and now haven’t seen my fiancé in 6 months. Please help me see this miracle come true and bring my fiancé to the States!
