Since 2008, the Riverside Tenants Association (RTA), a neighborhood association formed by tenants living in this building, has been fighting our landlord’s plan to build an underground 90-car garage in our backyard. Thanks to the relentless work of our attorney, Stephen G. Dobkin from Collins, Dobkin & Miller, LLP, and thanks to numerous donations of tenants living in our building and friends from our neighborhood, we have managed to prevent the landlord from proceeding with building the garage so far.
Most recently, thanks to Article 78 submitted by Collins, Dobkin & Miller, LLP, the judge of New York Supreme Court Hon. Pamela L. Fisher ruled that the Department of Housing and Community Renewal’s (DHCR) approval of garage project is not compatible with the rent stabilization law because it would substantially interfere with tenants’ daily life. Furthermore, Collins, Dobkin & Miller, LLP assisted by a civil engineer and an architect submitted a complaint to the Board of Standards and Appeals (BSA), demonstrating that the garage construction plan neglects tenants safety in an event of fire, whereby the building would become inescapable due to the courtyard garage construction. This led to our landlord’s withdrawal of the courtyard garage project from the Department of Buildings (DOB).
While we can celebrate these partial victories, it is possible that the landlord will submit the garage project once again, which will require further resistance. Moreover, we are still left with an outstanding bill that we owe to Collins, Dobkin & Miller, LLP for their past work.
