We are reaching out to our neighbors and friends to join us in opposing the proposed 15 Unit ADU project at 2833 Nutmeg, which currently has a pending permit application with the City of San Diego. After meeting with several of you, we have taken the first step by consulting with my law firm’s in-house land use planner, Daniel “Rock” Rockholt, who will be meeting with the City’s Developmental Services Department to review the project in detail. We have already pledged our own support to this effort and are seeking additional help from our community to ensure we have the resources needed to take meaningful action. There has been a preliminarily successful lawsuit brought against a similar project in Pacific Beach. We hope to use the momentum of that victory if needed to persuade the City of San Diego, or if needed, the Courts.

The funds raised will be used to cover the professional fees for my law firm’s planner and land use attorney. The planner will review the building permit application, obtain the plot plan, review copyrighted drawings, and potentially obtain a project issues report. He will also look for any recorded affordable housing agreements and investigate prior code enforcement actions. After this initial review, the planner will consult with a land use attorney to provide us with clarity on the best steps to oppose this project with the City. If needed, the funds may also support legal action, inspired by a recent successful lawsuit against a similar project in Pacific Beach. All funds will go directly toward their professional time and evaluation, ensuring we have expert guidance every step of the way.

This proposed project is not only dangerous in that it appears to violate fire code standards, it is woefully out of character with the historic solemnity of our neighborhood.
