MAJOR UPDATE

The following words are from Hailey herself.

Good morning family & friends for everyone that knows, which I think everyone does, I don’t really talk about it as I’m trying to move on with my life. Trying to find happiness, trying to find myself again. And it’s just been so hard trying to stay strong.

I was brutally assaulted and sexually assaulted by ISAIAH ORTIZ on the night of December 22, 2024. He beat me so badly I was flown to El Paso where I received treatment. ISAIAH ORTIZ was charged initially with 1. Criminal Sexual Penetration in Second Degree (Results in Personal Injury) 2. Aggravated Battery Against a household member (Great Bodily Harm) 3. Escape or Attempted to Escape Police Custody.

Rape Kit - Shows force innercourse, swelling, and lacerations. Bruising in that area thighs, legs. Along with bruising around my neck constant of being choked. DNA came back a match. Positive for Isaiah Ortiz.

Witness- The witness stated to police she took me home took me to my room when Isaiah Ortiz woke up, immediately grabbed me by my head and started putting my head on his genitals. I yelled stop get off me help. He threw me to the floor and I was laid out Isaiah Ortiz went after witness and she ran out the front door to go to her car and call the police for help. He locked the front door not letting her back in.

Police arrive/ Body Cam footage- Police arrive to the scene which was my home at the time. It took 10-15 minutes for them to get into the house. Going in the see Isaiah Ortiz (a naked man) run to the bedroom. Police go to the bedroom see blood on the door. They enter finding Isaiah Ortiz naked only wearing socks, crying over my body. I am laying off the bed dripping blood from my head, my eye, I’m unconscious. It took about 2/3 minutes to get Isaiah Ortiz out of the room by officers. Officer Chavez of LCPD found me in his statement is he thought I was dead until he found my pulse. I was exposed. No bottoms on and my crop top pushed up exposing my breast. Officers try to talk to me it takes me awhile to respond. I can’t really speak as I lost 2 teeth. Isaiah Ortiz punched me till my teeth fell out. But I regain consciousness during them talking to me asking for help crying for help. They ask me who did this to me. I respond with My baby dad. Isaiah. Then just back to crying and then silence. Paramedics arrive they start with IVs right there. Mind you it’s winter in las cruces New Mexico. Paramedics/fire department wrapped me in my blanket and carried me out of my house to the gurney outside. Sent to Mountain View Medical Hospital. At that hospital I was so traumatized just still exposed helpless just trying to keep my legs closed still fighting in a way. they eventually had every male leave the room. I only had lady nurses. And Female officer Martinez there with me the whole time until my family arrived.

From the beginning Isaiah Ortiz had hired an attorney. Pleading Not Guilty. DA prosecutor Ann Swank for State of New Mexico. Ok we will go to trial. Now that Trial was set for September 15, 2025. Well as I am preparing for trial as of this past Wednesday Sep. 10th The DA calls me and tells me that they offered him a plea of 4 years prison for 2 charges but that they are dropping the rape charge. Without me. The victims, awareness or consent, or conversation about that plea. Well yesterday Friday Sep. 12th there was a hearing for that plea in front of the judge. The judge accepted that plea. Isaiah Ortiz plead guilty to only 2 charges. The aggravated battery to household member & escape or attempt to escape police custody for 4 years in federal prison with 202 days time served.

The State Dismissed the Criminal Sexual Penetration in 2nd Degree charge. He will not have to register as a sex offender.

Sentencing is set for Tuesday September 16th 2025 at 1:15pm. As the judge gave me a choice if I want to be there. I will be since I was already gonna travel for the trial. I will speak up I will read these facts, I will tell the court the truth. I don’t understand how something like this can happen. I dont understand how with all this evidence. New Mexico can still just dismiss this. Silence victims. Let these criminals out. How can you just let a rapist back out there. With a slap on the wrist like as if nothing. Like as if I am nothing? Like what happened to me was just nothing?

I feel completely failed my the DA Office of Dona Ana. I feel completely failed by the justice system. This isn’t justice.

On December 22 2024 (her birthday) Hailey Valdez was brutally assaulted by her then boyfriend. Hailey sustained several facial fractures, two teeth knocked out and a few cuts to her forehead and eye lid that needed several stitches and lots of bruising on the body. Due to this horrible assault, Hailey was taken by ambulance to an area hospital. That is where we learned she will need ANOTHER ambulance ride to the las cruces airport to be flown to El Paso to UMC. Upon landing at UMC Hailey had a seizure. She was on a ventilator for 2 days and spent 4 days in the ICU. Then was taken to the main hospital for UMC as she didn't need as much care and would be released the next day on December 26 2024.

Due to this violent attack on Hailey, her and her 3 children ages 8 months, 5 and 6 had to move states to be safe with her parents, the Muñoz family which is Justin and Tammy, their 3 boys ages 13, 6 and 4. They also have a grandpa (Tammy father) to care for. They are all in one house until Hailey can get back on her feet and get back to work after her recovery. The Valdez/Muñoz family have a long road ahead of them any help is greatly appreciated!
