We are Freddie and Louise Montoya and our home is located in the south valley
of Albuquerque, New Mexico. Freddie designed and built our home 23 years ago
and raised their only daughter there. As well as Louise's elderly and ill mother
lived with us until her passing. Our home has high sentimental value to us. We are requesting funding to help us keep our home because due to circumstances that were beyond our control we are now on the eave of losing it to the bank.. The
following is a description of our current status regarding our home:

1.   The "Great Recession" started affecting many parts of the country in 2007. In           January of 2008, Freddie who is the major wage earner in the family started             working for NCA Architects in Albuquerque. During that period, the negative          effects of the recession had not been fully felt in New Mexico. However, by
       the fall of 2009, architectural firms in New Mexico started laying off
       employees at all levels. Freddie was laid off in January of 2010. 

2. Through the remainder of 2010, Freddie remained unemployed and actively 
     seeking employment. Freddie and Louise were able to pay their mortgage on 
     time using Louise's 25 hour a week caregiver job and bank savings. Credit cards 
     were used for all other expenses during the entire year of 2010.

3. In January of 2011, Freddie acquired a job at D. Sloan Architects, PC, 
     specifically to design a 32, 000 square foot correctional facility in Kayenta,
     Arizona. Freddie truly believed that this job would lift them out of their 
     financial depression. Meanwhile, the mortgage was payed on time as well as
     keep up with other debts and credit card payments.

4. In 2013, we tried to obtain a refinance of the property . We were informed that 
     due to the recession, the value of homes in the area had decreased to the point 
     where we could not obtain a refinance.

5. In March of 2014, Freddie was laid off from D. Sloan Architects because the 
     project was nearing completion. For the remainder of 2014 Freddie remained
     unemployed and consequently was unable to pay the mortgage as their savings
     were now depleted from the first period of unemployment.

6. Freddie and Louise applied for home mortgage assistance in July of 2014 and
     have been applying ever since to obtain a mortgage modification.

7. A complaint for foreclosure was filled on January 28, 2015 by Bank of America.

8. We requested from the district judge in charge of our case, for a mediation. The
     mediation was approved and so ordered by the judge. Subsequently, 
     a mediation was held on July 7, 2017  in which a modification was offered by Bank of America to the Freddie and Louise on that day. Another date was set at that time for July 24, 2017 to come back to the mediation so as to finalize the numbers for the modification. On the the day of the July 24 meeting, Bank of America
came back and reneged on their offer of a modification.  Stating that a person
with decision making status was not present at the initial mediation meeting.
Therefore, the modification did not happen

9. Our attorney filed a motion for sanctions against Bank of America and the 
    ordered another mediation in which she ordered for a decision making party to
    be present. 

10. The bank has delayed the new mediation until February 3, 2021 which has 
        been a full 3 1/2 years since they reneged on their offer. In the meantime the
        arrears have continued to accrue. We had a mediation on February 3, 2021
        and our modification was denied.  We will be filing an appeal on this. 

We are asking whoever is willing to help us in our plight keep our home, to donate
any amount they can so that we may be able to keep our home.
