Hey everyone. I have a civil rights lawsuit out against my landlord. And they retaliated by trying to evict me.
I’m appealing because the judge got the law wrong. In Miller v. Amos (2024), the state supreme court held that Fair Housing Act defenses apply to ALL forms of discrimination and retaliation in eviction cases, not just sexual-harassment ones. The judge said otherwise, which is a serious legal error.
He also refused ADA accomodations (28 CFR § 35.160); knowingly stated my confidential address out loud several times in court (a crime under CRS § 24-30-2109); and refused to permit amending for new evidence (CRCP 15).
I'm appealing to a higher court.
But I just learned that I have 10 days to come up with the appeal bond or I lose the right to appeal, and risk homelessness.
I’m not asking for handouts. I’m asking for help to make sure this case is heard. This appeal isn’t just for me, it’s to hopefully establish appellate case law that further protects civil rights of tenants (beyond Miller v. Amos).
I stand to win between $175k - $1m in my Civil Rights lawsuit but I need to make sure I don't get kicked out and preserve the appeal first.
