NFP COMMUNITY GROUP LAUNCHES LEGAL ACTION AGAINST STATE GOVERNMENT FOR ABUSE OF POWER AND LACK OF CONSULTATION - Planning Amendment 52.03 Turns Reserve and Residential Streets into Railway Super Station

Legislation means NO PARK, STREET OR PRIVATE PROPERTY in Victoria is safe from Government “BIG BUILD” Projects.

THE LEGAL CHALLENGE

Friends of Lorne Parade Reserve Inc (FOLPR) have launched an action in the Supreme Court of Victoria to bring the State Government to task for abuse of power and lack of consultation on the Surrey Hills Mont Albert Level Crossing Removal Project (LXRP).  On 9/11/21 Planning Minister, Richard Wynne was served.

The Government’s New Planning Amendment 52.03 gives unprecedented and unchecked power to the Planning Minister and the LXRP - not just for this project but any in Victoria.

Our local community is being bullied by the theft of Public Assets and amenity including a railway station (2 stations are being made 1), Lorne Parade Reserve, more than 600 canopy trees (value $30M+), local residential streets (Lorne Pde, Beresford St, Wilson St, Montrose St, Windsor Crescent & Churchill St), tawny frogmouth habitat and a WW1 Avenue of Honour.  Detrimental effects are airbrushed away and questions remain unanswered.

WE ARE SICK OF BEING RAILROADED AND NEED YOUR HELP TO CHANGE THIS GOVERNMENT'S APPROACH TO ALL LXRP PROJECTS

By DONATING you will help us have our day in court – we are fighting to return this project to the drawing board, get the station out of the park, save as many of our trees possible, and for a better outcome for our community, now and for future generations.

“We are witnessing environmental vandalism on our streets.   The impact on residents is extreme and yet the state government refuse to answer fundamental questions.  I am shocked and devastated at what I am seeing unfold in Surrey Hills and Mont Albert.” SA - Resident Mont Albert

“Our open green space is precious – It is not ok to steal parks – when it’s gone, it’s gone forever for our kids and kid’s kids.  Offsetting Public Open space with scattered postage stamps of land are not a replacement for open green space such as Lorne Parade Reserve.”  GG - Resident Surrey Hills
