URGENT HELP NEEDED TO SAVE EDEN SANCTUARY FROM FORCED AUCTION – ANIMALS AT RISK (español abajo)
Eden Sanctuary has been home to over 150 rescued animals from 13 species over the past 6.5 years. But now, due to fines for ‘illegal building works’ largely completed by the previous owners—fines the sanctuary never received notice of—the sanctuary faces a forced sale at auction in just 15 days, with the animals still inside.
What’s Happened So Far:
On October 17, 2024, Eden Sanctuary received a letter stating the property had been embargoed. Then, on November 4, they received notice that if the fine is not paid within 15 days, the property will be auctioned off to pay the debt.
Three years after Eden Sanctuary was established, its founder, Nicole, and the sanctuary’s 50 animal residents were forced to leave their second home. They had three months to find a new property and started a campaign to raise funds (more at edensanctuary.org).
A small team worked tirelessly, raising about €60,000 through donations, loans, and personal favours, but it wasn’t enough to secure a property in Mallorca. Finally, they found a place for €120,000 and, miraculously, a generous donor offered an interest-free loan to help cover the cost.
Throughout the purchase, the lawyer assured them the property could be lived in but could not have additional structures built on it. They were told only a concrete area near the house might be in question, and a fine of around €2,000 could be expected. Eager to give the animals a safe, permanent home, they took the risk and moved forward.
A Series of Tragic Events:
On November 28, 2021, Eden Sanctuary expected to sign the contract that would allow them to live peacefully. They had one month to relocate the animals, dismantle existing structures, and rebuild on the new property.
Just two hours after signing, Nicole received the devastating news that her mother had been diagnosed with pancreatic cancer. She passed away on December 15, just 2 weeks later.
While Nicole was at her mother’s side, volunteers kindly helped build fences and shelters for the animals. Then, on January 4, the police raided the property. When Nicole returned, grieving and exhausted, she was informed she could not live there due to €33,000 in “illegal building work”—work that had largely predated their ownership. This included many aspects of the property that she had been assured were legal.
Over the next year, despite battling insomnia and PTSD, Nicole lived out of bags and, finally able to get money together for somewhere to live herself, continued to manage the hugely underfunded sanctuary and work to pay her own bills.
The lawyer initially handling the case vanished after he filled a letter explaining they had not done the building work. A second lawyer took over but was dismissive of Nicole's concerns as they had not heard anything since the letter was sent. He downplayed the issue, suggesting if they had not received anything, there was nothing to worry about.
Finally, three years later, after Nicole announced she could no longer sustain the sanctuary, the second lawyer notified her of a substantial fine on the property. The paperwork revealed not only the fine but an embargo on the property, and the matter had escalated to the tax agency (ATIB), leaving the sanctuary facing auction.
The town hall attempted to contact the sanctuary about the fine over the years, but notices were never delivered and were instead published in the BOIB (Official Bulletin), meaning they are considered legally delivered.
They do not know whether there are also demolition orders. For a new lawyer (they would consider using Castell Lawyers , Palma who seem to have the most consistently positive feedback) to study the paperwork to see exactly what needs to be done they would have to pay 1,200 + 21% IVA, and results are not guaranteed.
Options for Saving Eden Sanctuary:
All legal advice has been bleak: had they known sooner, they could have contested the fine, but now it’s in execution and cannot be reduced. Two options remain:
Auction – The property is auctioned, and the sanctuary loses all control over the outcome. The fine totals €40,455, with an additional €60,000 still owed on the property. If auctioned, the debts likely won’t be covered, jeopardising the animals’ future.
Immediate Payment and Instalments – If funds can be raised quickly to make an immediate payment and set up monthly instalments, this may halt the auction. This would buy time to rehome the animals and possibly find a buyer to help pay off the debt.

Eden Sanctuary ha sido el hogar de más de 150 animales rescatados de 13 especies durante los últimos 6.5 años. ### Qué ha sucedido hasta ahora:

No saben si también existen órdenes de demolición. ### Opciones para salvar Eden Sanctuary:

2. **Pago inmediato e instalamentos** – Si se pueden recaudar fondos rápidamente para realizar un pago inmediato y establecer pagos mensuales, esto podría detener la subasta. Esto daría tiempo para reubicar a los animales y posiblemente encontrar un comprador que ayude a saldar la deuda.
