Help Miles Garcia-Kimock After Racist Attack

Hello all concerned! 

My name is Miles Garcia-Kimock, I am a 27 year old diabetic resident of Sebastopol, California and born in Santa Rosa, California.

On December 13th I was followed and attacked by an individual (white male, late 30's) on Santa Rosa Ave, Santa Rosa at the Oreilly Auto Parts Store.

He claimed I cut someone off(not him) in traffic (i did not) he parked his truck in the middle of the lot driveway not in a space, in a T-bone fashion to my car and did not allow me to leave.

He began yelling vulgarities and threatened to "kick my ass for what I did and to get out of my car.." he was not at my window at this point but in his truck opening the door and I rolled down my window and said "I'm going to get out but I'm going to get the parts I came here for, leave me alone".

He continued to be aggresive by yelling disparagements and got out of his car and stood waiting for me. I had an old machete in my vehicle from farm work I do in the area...normally I am a touring musician in my own projects and occasionally with my father Steve Kimock...a well respected guitarist in the industry.

I stepped out, told him "I didnt want to use this but it is my self defense and I will if he didnt back off and to stay away from me", he advanced and I retreated towards the trunk of my BMW. He said I "looked like a cartel member" and asked "if I was even legal.."; I said you're a waste of my time, sheathed the machete and put it back in my car. He proceeded to say "I'm calling the police because you threatened me with a deadly weapon and cut off multiple people in traffic..which was not true or not the whole truth...he said he had been rear ended twice this year and I wasnt going to get away with this. I proceeded to say loudly from 7-8 feet away to the police while he was making the call that he "isnt telling you the whole truth and not to listen to him."

I moved closer but still was 4-5 away and stopped and said "let me speak with the police about the statements you are making..."

I never hit or pushed or touched him. His left shoulder was facing me and quickly he took a couple steps to his left and swung with his right fist catching me in my left cheek and knocked me to the ground, I tried to get up and he hit me again but I was able to stay on my feet; he got over the top of me and began punching my head multiple times, he blocked the door to the Oreillys building and I ran around the side, he caught up to me and hit me in the face and head multiple times again, i ran further away without any defense.

He caught up to me again and pulled my jacket off and got me to the ground where he landed another 10 or so blows and i managed to try and get on my feet to run further away but he got on top of my and pinned me to the ground repeatedly hitting me and then grabbed me by the hair(back of head) and slammed my forehead into the ground another 10 times until my head cracked open and began bleeding profusely. He said "You illegals come into this country and think you wont be held accountable for the things you do" I told him i was born in Santa Rosa and he said "Doesnt look like it.."

At this point he hit me a few more times and tried to break my index fingers but only ended up tearing the ligaments(this is a serious injury to me as my job is playing guitar) my car keys fell out of my pocket and he ripped them off the chain and threw the keys into the storm drain my head was next to.....he told one individual driving by that he had disarmed me and I was dangerous...the individual drove away while I was screaming for help.

He put his knee on my neck and held my hand behind my head until the officers he had been on the phone with arrived and saw he had me pinned. They asked whos blood was pooled on the ground and he said it was mine, they asked him to get off me and go sit over there, They began to cuff me but realized i was severly injured and decided against it. He changed his story twice as I was in the ambulance, from he disarmed me and I started the fight- to I did put the machete away willingly and that he threw the first punch.

The officers then charged him with Felony Battery and hate crimes but did not arrest him on the spot.

I was admitted to the ER for assault, finger sprain, forehead contusions and facial lacerations and received sutures. I will need physical therapy and desire some PTSD counseling. I will also be hiring a lawyer to sue this man for what he cost me currently...I cant play guitar or give lessons or do the farm work I rely on for money and food here at the end of an already hard year for me (and of course, for a lot of us too)
I am sharing my story with you so we can raise awareness about the increasingly open acceptance of prejudice in the current social atmosphere of our society. I hope we can all do something going forward to give emotional and financial support to more people who need it.

A portion of the money I generate through this campaign will go to a non-profit of my determination( I am open to suggestions).  I will need the the money between now (for the cost of bills I will need for medicines and therapy), I have not generated much income because playing music has been put on hold and a month from now when I begin the law-suit. Also If anyone who knows me personally would like to send a small email containing a statement about my character to help the judge determine I am not an agressive person myself would be really helpful. I am sorry for the part where I drew the machete, that was not a good idea but I feared for my safety and wasn't think clearly about what to do next when threatened by him...next time, I will call the police from my car and report whats going on.

Thank you for your time in reading this and as a community of my friends and family, we can keep this man and his hatred off the streets and under full penalty of the law. The place I was assaulted is of a mostly Mexican-American populous and its not hard to imagine he might do this again to someone else.
