Back in 1999, my green card, Social Security number, and driver's license were stolen by someone I met while attending Live Oak High School in Morgan Hill, CA. This person committed auto theft and other felonies using my identity. The nightmare began when he was booked by the sheriff's department in San Jose and presented all my documentation as his own, but the person in charge of taking his fingerprints didn’t do it. As a result, he was booked under my name, Mauricio Javier Montoya, the first time. He was released, but the second time he was arrested, fingerprints were taken and he was booked under his real name, Domingo Rojas, with my name as an alias. Because his fingerprints weren’t taken the first time, my life has been a nightmare ever since. I have been wrongfully detained and arrested more than 78 times by various law enforcement agencies since 1999. There is still an active warrant without bail for Domingo Rojas, the person who stole my identity. I have lost jobs, suffered embarrassment, and been treated like a criminal for something I didn’t do. Despite a letter from the sheriff’s department stating I am not affiliated with this person, nothing has changed. A judge refuses to separate our records, and I continue to suffer the consequences.
The funds will go directly toward legal fees so I can finally clear my name and end this nightmare. I have a lawyer willing to take my case, but I do not have the resources to pay for the legal help I desperately need.

He is Colombian and has been in the US since at least his teen years. He has a very heavy accent so I have a little trouble understanding some of his story but I know enough to know there is an injustice happening to him and he needs our help. His attorney wanted me to work with him because he was suicidal. I spoke with him for 3 hours the first time over the phone when we were connected. I made a strong bond with him and he believes that this interaction saved his life . I continued to work with him pro bono because the more I heard of his story, the more I realized how he has been harassed and wronged at no fault of his own. He continues to be arrested over and over due to what I’m about to share with you. I have received his permission to tell his story. Apparently when he was a teenager in 1998 or 1999, and he was in a car getting a ride along with another guy that he kind of knew but was only really an acquaintance. The other man’s name is Domingo Rojas. Javier accidentally left his wallet as he got out of the car that gave him the ride. Domingo Rojas saw Javiers wallet and stole it. The wallet contained Javier’s ID, driver’s license, social security card and green card from immigration . Domingo Rojas was later arrested in 1999 for burglary and used Javier’s ID like he was Javier. The police department (Santa Clara sheriff’s Department ) arrested Domingo Rojas and did not bother to get or run finger prints. They never checked out the information which would have shown that Domingo Rojas was using someone else’s ID, and they booked him under Javier’s name. Since then this man has been arrested numerous times and at some point law enforcement figured out that he was not Javier but they put down “aka” instead or removing and separating Javier’s name from the crimes and persona of Domingo Rojas. Javier has trauma from being raped as a child by a man who was his school teacher. (I asked him if I could be transparent with you about this trauma and he said to tell you everything ). He started drinking to cope with the pain and has been arrested before on DUI. But he has never been involved in any criminal activity. He has been arrested more than 70 times under this man’s warrant. They issues some kind of paper to Javier saying that he isn’t Domingo Rojas but it has made no difference and they continue to arrest him. He had lost several jobs because they have come to his place of employment to arrest him and even though they eventually let Javier go, it’s too late. His employers fire him anyway. This has made him lose hope for any peace of mind in his future and he has been suicidal off and on for years over the pain and suffering. He has been harassed 18 times this past year alone. He was also in an abusive relationship with a women who would abuse him regularly. He wanted to call and report it but couldn’t because he is terrified of police. He has tried to end his life 3 times and had a colostomy bag from the injuries he sustained. He is harassed still but does not want to end his life now because of the 3 hour call he had where I explained to him that his abuse he endured was not his fault and that he can heal if we work on it. I also found out he has one child, a daughter, who is in the United States Army currently serving our country. I talked to him about the importance of Dad’s. That my dad is everything to me and my life would not be the same if I lost him. His daughters life would forever change and not for the better. She as well as his mother’s lives would be destroyed by his suicide and the trauma they would endure, they would pack with them everyday. They would never be the same. He now has realized this and wants to live. He has been sober since the beginning of the 2022 and is trying to rebuild his life but is constantly harassed by the Morgan Hill police department who have arrested him 18 times this past year alone. He was arrested this week as well. He told me he lives in fear to go anywhere. He has called me crying several times just wanting to figure out how he can live in peace and free of fear from being unfairly targeted and harassed. He called last night in fact after they detained him again running his information. I asked him why they detain him or what the reason is for them to try to arrest him. His vehicle was stolen and he reported it. He told me all he wants is to get separated from this Domingo Rojas and also to be left alone to live his life in peace serving God and helping others who need help. Because of everything he has endured he now has the medical conditions where he needs to urinate frequently and is working with doctors to help him. He was hospitalized when I arrived here in the end of October 2022. He also has a therapist who is helping him with his trauma and I’m supporting him too because I believe in him and can see he is trying so hard despite the injustices that plague him. I don’t know what to do to help him get his identification and greencard separated from this Domingo Rojas. Any advice you could give or steering us in the right direction would be greatly appreciated. Like I said, I’m doing this because his attorney originally connected us and had me work with him because he was suicidal. Now it means more to me to help this good soul achieve peace. It’s not fair that he is enduring this. I actually feel a responsibility to help advocate for him because he is a minority that no one is listening to . I feel he is targeted unfairly and it isn’t right. This is outrageous and shocking that it has gone on this long. I am honestly out of my element here.
