America has been gradually stripping away the rights of transgender individuals over the years. This situation has worsened significantly since Trump took office. As a result, Luna, my partner who has been with me for nearly a year (May 17th), is seeking permanent residency in Canada, a country much safer for someone like her compared to the small town in the very red state where she currently lives. She visited here for a month during the holidays and fell in love with the country, where she felt safe to authentically express herself without fear or ridicule.
Our Planned Pathway
Luna and I have been in talks with an immigration lawyer who advised us that, based on our circumstances, family sponsorship via marriage would be the best course of action to allow Luna to move to Canada permanently. This would require Luna to come here as a visitor, acquire a marriage license to be legally married to me, and apply for inland residency. During this application process, Luna and I will be screened to meet qualifications (financial and criminal records, etc.).
Coming as a visitor first means leaving her belongings in America while we wait for confirmation that her applications are being processed. Once we receive that, Luna can apply for a work permit, which will allow her to send her belongings here. Our plan with this is to send her belongings to her chosen family for temporary storage before sending them over to us.
