Hi, my name is Lindsey.
I never thought I’d be writing this. But I’m in a fight for my home, my health, and my future—because of a nightmare my insurance company caused.
Two and a half years ago, a pipe burst in my home while I was out of state. This resulted toxic mold from water damage. It destroyed my health, left me unable to work normally, or even function at all, and turned my life upside down.
The near lethal levels of mycotoxins in my body caused severe nerve and brain damage, I am in excruciating pain every day. I can't retain information and I struggle with memory and cognitive function overall. The prolonged state of panic and fear has altered my personality and stolen my joy.
Instead of helping, my insurance company delayed the approval or denial of my claim for 202 days after I reported the discovery of mold. This was a covered loss, and for 9 months they made me believe this would be covered and made right. Since I couldn't live in my house this entire time I had to go live out of state with family because the I was initially told the insurance company would reimburse me for the hotel stay.. which never happened.
Then they ended up denying my claim after all of that time!
14 months ago I hired an attorney who I trusted to fight for me. I knew the drawn out timeframe of a lawsuit, and I was determined to make it work and get by, knowing it would be a challenge —But that attorney who was suppose to fight for me, he sabotaged my case behind my back, filed motions without my consent, and withheld my legal documents throughout the entire case. I’ve since had to fire him and am now trying to navigate a federal lawsuit alone, while searching for a new attorney to take over.
Because of all this...
I owe back payments that could put my house at risk.
My utilities are in danger of being shut off.
My medical bills and debt have piled up due to this crisis and having to foot the bills that were suppose to be reimbursed, growing interest every day.
I’ve lost income because I’ve been forced to act as my own legal advocate, file motions, and even go to a hearing just to retrieve my case files, and this instead of running my business really set me back this month.
For the past year, I know I just had to make it to June because this was my trial month. So if we don't settle, I at least needed to make it to then. I did it! I figured out how to survive this long....
Only to find out I now essentially have to start over!
I could have never prepared for this. I had an attorney ready to take over my case and help me settle right after firing my former attorney, BUT my former attorney was withholding all my case files so I wouldn't be able to secure new counsel. For TWO MONTHS I have been fighting my own attorney to get information that was legally mine.
This has caused a huge financial setback. I worked so hard to make it to this point, and I only need help to stay afloat until I can actually secure new counsel and either settle or get pre-settlement funding to get by.
Currently, I’m facing an immediate emergency.
My monthly costs are unusually high right now because I’ve been fighting this legal battle alone. Once I secure a settlement—even a modest one—I’ll be able to pay off my debts, reduce my expenses, and rebuild my business. I’m not trying to live indefinitely on donations!
I’m simply trying to survive long enough to finish this fight.
It kills me to think I was this close... and still ended up losing everything.
I put so much work into this lawsuit because I knew I had rights, I knew they acted in bad faith, and I worked so hard on my home I will do whatever it takes to save it!
I really thought if I worked hard enough, I would make it. But I’m out of time, and I can’t do it alone anymore.
I have an Etsy shop and online boutique, but I've had people request I start a go fund me because they wanted to help me through this without adding any work to my plate. I am embarrassed to ask for help, but I am truly out of options at this point.
