We want to share a clear update on how funds raised so far have been used and what the next step looks like in Josue’s legal case.

Through your generosity, $8,000 has been raised since we started the GoFundMe when Josue was detained about six months ago , which helped our family navigate the most immediate challenges following Josue’s detention. Of those funds:

$4,000 has been used toward legal fees, including attorney consultations, case review, and preparation related to Josue’s appeal and detention

$4,000 was used to cover essential household expenses, as Josue was the primary provider for the family and his detention left Maria managing all financial responsibilities alone

These funds allowed us to stabilize during an incredibly difficult period, but they do not cover the full cost of moving forward with the habeas corpus petition.

To proceed with filing the habeas corpus case, which attorneys believe is Josue’s strongest and most direct option to challenge his continued detention, an additional $8,000 is required to retain legal counsel and complete the necessary legal work.

This step is critical to addressing the legality of Josue’s detention while his appeal with the 10th Circuit remains pending. We are continuing to fundraise so we can move forward with this process and give Josue the opportunity to return home as this fight continues.

Update: We Have a Strong Legal Path Forward - Habeas Corpus

We wanted to share an important update on Josue’s case and where things stand right now.

After a recent consultation with the law firm, the attorneys confirmed that Josue meets all the requirements to file a habeas corpus petition, and they believe we absolutely have a case. Based on their assessment, we are looking at an 85–90% chance of success.

For those unfamiliar, habeas corpus is a fundamental constitutional right that allows a detained person to challenge unlawful or indefinite detention. In simple terms, it forces the government to bring the detainee before a court and justify why they are being held.

In Josue’s situation:

ICE detained him without a valid reason

DHS placed a false charge on his record

He has now been detained for nearly six months

The court denied his motion to consider bond, not because he was a danger or flight risk, but because the judge said they lacked jurisdiction

As a result, Josue has been held without bond while his 10th Circuit appeal remains pending, with no clear timeline or explanation

The attorneys were very clear: habeas corpus is our strongest and most immediate option to challenge this detention and bring Josue home while his appeal continues.

The cost to move forward with this habeas corpus case is $8,000. This covers the urgent legal work required to challenge his detention and hold the government accountable for keeping him confined without lawful justification.
