I need help and I’m reaching out.
I was stopped in an unconstitutional road block that was engineered and targeted towards a certain group of people and I need a lawyer.
Here’s my story: This year I decided to attend the National Rainbow Gathering in Georgia. Upon entering the national forest I came to a road block made up of several different kinds of law enforcement. They were set up waiting to search any and every vehicle that they could. I was not wearing my seat belt which prompted them to have a drug sniffing canine check the outside of my vehicle. According to the police the canine hit and I was told to exit my vehicle. The officers asked me if I had any illegal drugs in my possession. To my direct knowledge I did not and informed them as such.
In the back of my truck I had my fuel dump container which is a large black box with a lock on it. They asked me what was in the box and if the key to the lock was on my key ring. I replied that it contained fuel and my performance equipment. I told them which key it was on my key ring that would unlock the lock on it as well. While searching my fuel dump they found an old brownie sitting in the bottom of the box mixed up with the other trash that accumulates in my dump over time. The brownie was squashed, soaked in fuel, and obviously inedible.
This brownie was a pot brownie. This pot brownie had been gifted to me at an event a few months back and while leaning over my fuel dump it fell out of my pocket into my dump. I left it there disregarding it as trash and forgot about it. I purposely had no illegal substances in my possession.
When asked about the brownie by the police I admitted that it was a pot brownie and was promptly arrested. I was charged with felony possession of THC and put in jail for several days. My bail was posted at $6000 and was lucky enough to have friends put that amount up for me. My bail stipulations are that I am not able to own or consume alcohol and I have surrendered my fourth amendment right to illegal search and seizure.
Currently I am facing a possible felony conviction in Georgia. If convicted I am facing 6 months to a year in prison or several years of probation. I am one of 900 people who were given a citation and one of 500 people arrested who were trying to attend the Rainbow Gathering. This amount of arrests is unheard of in Rainbow history. Georgia has no sympathy for us and they have every intention of trying us to the fullest extent of the law.
It is in my best interest to hire an attorney and do the best I can to avoid prison time for this. The cheapest lawyer I am able to find in the area who is willing to work with me costs $4500. Half of which I need to present to him before he is willing to look at my case. My committal hearing is August 23 and I need to present $2250 to my lawyer one week prior to this date at the very latest.
I understand that THC is illegal in Georgia. I understand that I was caught with an illegal substance in my possession. I understand that however unintentional this was that I have to deal with the repercussions of my actions. However I and the lawyer I have spoken with believe that these road blocks were unconstitutional. It is clear that this whole experience was an egregious display of police power and an obvious means of extracting as much money as possible from the Rainbow community. The state of Georgia decided to make an example of Rainbow attendees in order to make sure that the Rainbow Gathering never sets foot in Georgia again.
I sincerely feel uncomfortable asking for help. As I stated above I understand that I engaged in an illegal activity but I do not believe that I should spend time in prison for this. If I have ever helped you before and not asked for anything in return, if I have ever inspired you, held space for you, assisted you, or generally been kind to you for no reason, or if you just have the capacity and willingness to help I am asking for your help now. Please, help me get proper representation in court and stay out of prison. Thank you for your time in reading this.
