On August 15th a City Water Main broke underneath the ground in front of HQ and shot water towards our basement structural wall with such force that the brick wall bent, and then exploded into the building. Our 3200 sq foot basement with 10-12' tall ceilings was completely filled up to the ceilings with water and mud. Emergency crews got the water turned off minutes before the water made it up to the main floor.
Unfortunately damage caused by "water originating outside of the building" is a common exemption in all insurance policies in the State of Colorado, and we received a COMPLETE DENIAL OF COVERAGE from our insurance company.
Denver Water is protected by laws creating a "No Fault" situation on all water main breaks in Denver.
It is possible to file a lawsuit against the City, but lawyers have advised us that process would be 3+ years long, cost over $100,000, and be a long shot to win.
HQ HOLDS ZERO RESPONSIBILITY FOR WHAT HAPPENED, BUT IS STUCK WITH 100% OF THE REPURCUSSIONS!
We had initially hoped that construction would be complete by late October. Recently we were informed that construction delays will push our re-open date back into late November AT LEAST. This means our BEST CASE scenario is now being closed from Aug 15th through Thanksgiving....missing the entire Fall concert season, the busiest and most profitable time of the year for every Live Music Venue.
Close to $100,000 worth of equipment and supplies were destroyed in the flood. Zero income for the busiest quarter of the year. Our entire staff has had to scramble to find other work, and countless artists have been forced to have their shows moved or canceled.
We had hoped to avoid asking for more help, but now that we have exhausted all other means of aid, and have had our reopen date pushed back another month AT LEAST, we are humbly coming to you, the community, for some financial help in rebuilding and reopening HQ.
