My name is Jocelyn Cappozzo, many of you may or may not be aware of my current situation. I am going through several lawsuits, both civilly and criminally against my husband, Dia A. Beshara. I recently found out that we were given a trial date, which is going to be an exorbitant cost, and is quickly approaching.
In March of 2021, he and I became pregnant, and I later sustained a miscarriage. A short time after, I found a medication blister pack in my husband’s belongings, it was called “Pregnot Kit”, and there was a missing pill, Mifepristone 200 mg (aka the abortion pill). This prompted me to start searching for a lab that could test my hair for the drug, because I started to suspect that he did the unthinkable. I finally found a lab in San Diego to perform the forensic testing on my hair sample.
After receiving the forensic evidence from my hair sample, my suspicions were confirmed. My hair tested positive for mifepristone, measurable down to the amount of picograms. I was given the abortion pill, against my will, without my knowledge or consent, and I lost the pregnancy. Once confronted, he admitted to purchasing it online a few years ago from India, but he couldn’t give a valid explanation as to where the missing pill was. Well, I confirmed exactly where it was.
Unfortunately, due to NYS laws, a fetus does not have any rights, therefore the felony charges will not be tried, and he will continue to walk free. Throughout the past couple of years, I have connected with a number of women who have also been victimized by his abuse, and I am grateful to have their support in getting the justice I so desperately seek, and that we all deserve. Sadly, I have learned how unjust the judicial system can be, but I am determined to make sure some sort of accountability is held, which is why I am adamant about pursuing the civil lawsuit. It is also noteworthy, that during his deposition, when asked about how he came to possess the blister pack and why the abortion pill was missing, he stated that he refuses to answer on the ground of the 5th amendment, because the answer would tend to incriminate him.

After almost 3 years of legal proceedings, and no settlement, there is finally a trial date set for the end of January, but the biggest obstacle for me is the cost to litigate and try this case. According to my attorneys, it is going to cost me approximately $70,000-$100,000. If I do not come up with the funds, I will not have the opportunity to bring this to trial. I have done everything I can so far to make sure accountability is held, and this is my last-ditch effort.
I am asking for any donations possible to help me accomplish this goal. I understand there may be many unanswered questions, but I need to be cautious about what details I provide due to legalities. I encourage and welcome anyone to please feel free to contact me with any questions or concerns.

What will the funds be used for?
• Attorney fees
• Litigation - trial prep, jury selection, etc.
• Expert witness fees – 2 experts, one is local, one I will have to fly out from San Diego, provide hotel and meals for a few days, trial preparation for both, etc.
Why is this cause important to me? My life was dramatically impacted by this event. Aside from the psychological trauma I’ve endured because of this loss and abuse, I feel I was robbed of my choice, my reproductive and human rights, and my opportunity to be a mother. I lost my unborn child, because the man who I thought loved me, betrayed me in a way that is unfathomable. I will always wonder what my child would have looked like, what her laugh would have sounded like, what mischief she would get into, and what great things she would accomplish. I did not know the gender yet, but in my heart, I felt it was a girl. I will never know the answers to the above, I can only imagine. This is why it is so important for me to find some sort of justice. I did not get that from the criminal case, I’m desperately hoping that I will in the civil lawsuit.
Why do I need the money? I think most people understand that litigation is tremendously expensive, which is why most cases settle before going to trial. Unfortunately, we have not been able to settle, therefore a trial is taking place, and I do not have the financial means to do it alone. I am looking into loans as well, and possibly part of my retirement, but I would like to avoid the latter at all costs.
Who will this money help? My hope is that this case will raise awareness. Awareness about men slipping pregnant women the abortion pill against their will, awareness about how different state laws handle this horrific act. While some states don’t even consider it a crime, others consider it murder. I hope that this case educates women about their rights regarding this unique situation, and possibly prevent this from happening to other women. If I can prevent this from happening to even one woman, I will know this was all worth it. I also think it is important to raise awareness about NYS law regarding giving someone a drug without their consent. I understand making any change to the law would be a massive undertaking, but I believe this part of NYS law is worth revisiting.
Can the opposing party pay my attorney fees if I win the trial? Short answer, no. It is a common misconception that the prevailing party will have the opposing side pay their attorney fees, which is not the case because of the “American Rule”. Some states have exceptions for abuse and frivolous lawsuits regarding the American Rule; NYS is not one of them.
What will happen to the money if I don’t go to trial? If for some reason this doesn’t end up going to trial, I will use the funds to help with the several tens of thousands I have already spent on my attorney fees, as this is not a contingency based case, I pay hourly.
