I’m Dr. Yedil Dyussembayev, a physician who overcame immense obstacles—working tirelessly and relying on my elderly parents’ life savings—to secure a U.S. residency. Today, shocking retaliation from my program has cost me that position, endangering my 5-year-old daughter’s autism therapy.
Retaliation for Exposing False Visa Promises
The program publicly advertised sponsorship for international graduates but secretly filtered out anyone needing a visa. When I accidentally revealed this, they responded with fabricated complaints—weaponizing my family’s special needs to label me as —“unable to manage time due to his and his wife’s ADHD,” despite never having met my wife or having any official diagnosis. They also twisted my disabilities into allegations of misconduct:

My struggle with eye contact due to ADHD was reframed as a baseless claim of making colleagues uncomfortable, including false harassment allegations when I wasn’t even in the same state as the supposed “victims.” showing the accusations were purely fabricated to tarnish my name.

2. Hearing Loss Miscast as Aggression (case #17 part III)
My partial hearing loss sometimes causes me to speak louder. Instead of accommodating this known condition, supervisors labeled me “unprofessional” and “rude.
3. Penalized for Compassionate Patient Care
One day, I treated a military veteran with a 15+ year chronic medical issue (made worse with combat injury at some point) compounded by a two-year gap in care. Veterans face higher risks of mental health struggles and suicide, so I carefully assessed his chronic pain and reviewed his mental health. During our discussion, I recognized behaviors that suggested a possible underdiagnosed mental health condition in adults. Although the program mandated addressing only one issue per visit, I did not feel comfortable ignoring the potential impact of an unaddressed mental health disorder. I performed a confirmatory screening test, which validated my concerns. By identifying this condition early, the patient gained a new opportunity to improve his quality of life.
Instead of acknowledging the importance of comprehensive, patient-focused care—particularly for a veteran with complex medical and mental health needs—the program punished me for exceeding an arbitrary time slot, labeling me “inefficient” and “dangerous to patients.” They demanded I limit future visits to a single complaint, no matter how urgent or multifaceted.

A Broken System That Ignored My Pleas
In January 2025, I reported these incidents to institutional leaders and external agencies (DoJ, Texas AG,TMB,ACGME, OCR, Department of State and more). Most opened my emails multiple times yet never responded. With no support, my only option is legal action. The ACGME, the federal accreditation body, informed me they do not intervene in disputes between individual residents and their programs. Essentially, no one offered help, leaving me with no choice but to seek legal recourse on my own.
Why I’m Fighting Back: Legal Battle and What’s at Stake
I never wanted to be in a courtroom; I came to the U.S. to save lives, not file lawsuits. I have only 35 days to initiate litigation. (Update 3/3/25: My legal status got secured) Missing that window could permanently cost me my ability to hold the program accountable—and to complete my medical training.
This case isn’t just about me. If a residency program can lie about opportunities, retaliate against international graduates, and discriminate over disabilities, it will do so again. I am determined to prove that no institution is above the law. My case could highlight the urgent need for stronger protection for medical residents - especially international physicians, those with disabilities, and parents of children with special-needs.

Our 5-year-old daughter, Mariam, is autistic. The specialized therapy she receives here has transformed her life. Losing my residency puts this crucial treatment at risk. Beyond my career, this fight is about safeguarding Mariam’s future.
