The Hidden Crime in Plain Sight
My name is Danielle del Prado, and I never thought I’d become the victim of identity theft by my own spouse.
Someone I trusted opened loans, credit accounts, and used my personal information — all in my name.
When I discovered it, I was told: “Don’t worry, I’ll repay you… the money’s coming.”
Every promise turned out to be false.
I paid off debts myself to protect my credit and my future, believing repayment would come.
It never did.

Where I Stand Now
On October 27, 2025, the Oregon court ruled in my favor.
The judge confirmed that my spouse misused my identity, breached fiduciary duty, and caused severe emotional distress.
This is now legally established and cannot be denied.
But here’s the shocking truth: even after proving everything, the court made clear that Oregon has no civil tort for identity theft. Victims like me can’t directly sue for “identity theft” damages the way people can in states like California. We’re forced to fit it into other legal boxes — leaving huge gaps in justice.
That’s why I’ve now filed a Motion to Amend the Judgment and plan to appeal.
This case is the first of its kind in Oregon, and I intend to make it count.

This isn’t just about recovering what I lost. I’m fighting to change the law — so that when this happens to someone else, they won’t have to battle alone.
