Florida just handed the government a dangerous new power.
It can now label people and organizations as “domestic terrorists” and punish those who “promote” them. Not just for violence. Not just for criminal acts. For speech, association, and ideas. And it can happen without meaningful due process.
There is no clear notice. No guaranteed hearing. No meaningful opportunity to challenge the evidence before consequences are imposed.
That is not justice. That is the power to label.
This law allows the state to label individuals or groups as “domestic terrorists,” penalize speech it interprets as “support,” act on information you may never see, and force you to defend yourself after the damage is already done.
Because once a label is applied, it does the work. It isolates. It stigmatizes. It punishes. All without a trial.
We have seen this pattern before. Governments do not silence everyone at once. They start by labeling the inconvenient.
Under a law like this:
• A student could face consequences for discussing controversial ideas.
• A journalist could be accused simply for reporting.
• A professor could be targeted for teaching.
• A lawyer could be scrutinized for advising a client.
• An everyday person may hesitate before speaking at all.
And when people hesitate to speak, they stop speaking.
That is how rights disappear in practice.
In this country, we punish acts. We do not criminalize ideas. We do not assign guilt by association.
This law crosses that line.
Today it’s them. Tomorrow it’s you.
If the government can label them, it can label you. If it can punish their speech, it can punish yours. The First Amendment Foundation is preparing a constitutional challenge to stop this law in court.
