My name is Elian, and I am reaching out for urgent help on behalf of my children, Lucas and Elise. Their safety, stability, and emotional well-being are at risk due to a deeply troubling and complex family court situation.

 Urgency:

•  For over a year, I have been working with the Yuma Superior Court to secure my children’s well-being. I represented myself throughout the process, and there were many hearings because of the lies. 
• In September 2025, I was awarded 50/50 custody of Lucas and Elise. It was one of the best days of my life, but it was short-lived within a month. 
  
• After their mother lost her urgent hearing for sole custody in October 2025, she turned to a group calling itself the “Texas Band of Yaqui Indians.” 
• This group, according to the Indian Law Library, is not federally recognized and is registered as a nonprofit in Texas.
• Despite this, a California attorney (not licensed in Arizona) wrote an Order of Protection and Child Enforcement, which has prevented me from seeing my children since October 2025. I was served court papers on October 17. 
• The judge listed on the paperwork, Mia Perez Arroyo, is not licensed to practice law in Arizona or Texas. 
• The Yuma County Sheriff’s Office enforced these orders, even though they are not legally valid.

 I know that this is an emotional toll on Lucas and Elise. They love me, and now they must think I abandoned them. Lucas and Elise have been caught in the middle of a confusing and painful legal battle. They have been separated from a parent who loves them deeply, and every day apart increases their anxiety, fear, and sense of instability. The uncertainty and disruption have affected their routines, their ability to feel safe at home, and their trust in the adults who are supposed to protect them.

 They deserve to grow up feeling secure, loved, and supported—not worried about where they will live or who will be there for them. The longer this situation continues, the greater the risk to their emotional health and development. I see the impact in their sadness, their questions, and their longing for normalcy.

 As their dad, I am devastated to be kept from my children—not because of anything I have done, but simply because their other parent remarried and does not want to co-parent. It is deeply unfair that my children have lost access to a loving parent due to choices and actions outside their control. Every child deserves the love and guidance of both parents, and Lucas and Elise deserve to have me in their lives.

 I am fighting not just for my rights, but for their right to have a father who is present, supportive, and actively involved in their upbringing. I want to be there for their milestones, their struggles, and their everyday joys. No child should be forced to lose a parent because of someone else’s refusal to work together for their best interests.
