Two years ago my partner and I concluded our search for the home of our dream restaurant Jaeger Haus. We bought the lot with a bar/restaurant on it that had been in existence for over 70 years. It was close to our home and just out side the village of Tivoli where I had raised my sons and worked for many years.
My partner had moved here more recently after concluding an over thirty year run as the owner of the Raccoon Lodge in Tribeca, a little bar around the corner from Ground Zero, one of the very few business to stay open during the aftermath of 9/11 and offer refuge to the workers involved in the recovery and clean up efforts. The Raccoon was forced to close when developers bought the block in order to build a high rise. My partner lost his business but not his passion for the family atmosphere that can develop around love of good food and Craft beer.
All seemed to be going smoothly until we discovered that our lots' leach field was not where we were told it was. It turned out that in fact it was on another lot. Additionally neither lot had soil that would PERC. (the ability for soil to absorb and filter waste water). This meant that for years the waste from every business that had existed on what is now our lot, had been draining in to an inadequate leach field on another lot polluting our local watershed.
So began our two year journey to find a way to save our dream and to save the surrounding wetlands from further harm. After a lot of research, we found out about Aerobic Septic Systems. These systems use bacteria to clean the water before it even goes through the leach field. These systems have been used in New York state and elsewhere for locations with our exact situation of non-PERC soil. Although this type of system was an expense that we had not anticipated, we decided to go ahead and have our engineer draw up plans that were eventually approved by the Dutchess County Health Department. However The DCHP added the requirement that we include in this system a super fill leach field. The Super Fill is a requirement for all new construction and we are required to have it despite our property having had an existing business in operation for the past 70 years. A Super Fill leach field is not actually required for an Aerobic system under normal circumstances, because it puts out 99% pure water.
Exhausted and at our wits end we had no choice but to accept the DCHD ruling and to move forward with our new aerobic system with the super fill. The added cost of the the super fill grew to 60,000 dollars above what we had anticipated, and so we are looking to our friends, family, and neighbors for a little help.
