Background
I am seeking support to pursue a judicial review of a decision issued by the Ontario Labour Relations Board.
This process allows a court to determine whether the decision was made fairly and in accordance with the law. I am currently self-represented and covering the costs personally.
This matter arises from a proceeding before the Ontario Labour Relations Board involving labour representation in the healthcare sector.
Following the Board’s decision, I identified issues that I believe were not fully addressed within the decision-making process. As a result, I am seeking a judicial review so that the court can assess whether the decision was made in accordance with the applicable legal standards.
As this matter is currently before the courts, I am limiting the level of detail provided here.
What Is a Judicial Review?
A judicial review is a legal process where a court reviews the decision of an administrative body, such as a tribunal or the Ontario Labour Relations Board like in this case, to determine whether it was made in accordance with the law.
This does not involve re-hearing the case or reconsidering all of the evidence. Instead, the court examines whether the decision-making process was fair, reasonable, and consistent with legal principles, including procedural fairness.
If the court finds that there was a legal error, it may set aside the decision and return the matter to the tribunal for reconsideration.
This does not simply mean repeating the same decision. The tribunal must reconsider the matter in accordance with the court’s reasons, correcting the identified issues. This may involve a different decision-maker or a differently structured process, depending on the circumstances.
Courts do not decide the case themselves, but they ensure that it is decided properly.
How This Relates to My Case
In my situation, I am asking the court to review whether the decision was made fairly and in accordance with applicable legal standards.
If the court determines that there were issues with the decision-making process, it may require the matter to be reconsidered. This could allow the relevant issues to be addressed through a process that meets the required legal standards.
I am committed to pursuing this matter carefully, thoroughly, and in accordance with the legal process.
Why This Matters
This application concerns broader principles that extend beyond my individual circumstances, including:
- The right to a fair process
- Meaningful participation in decisions that affect individuals
- Ensuring administrative decision-makers act within their legal authority
Judicial review plays an important role in ensuring that administrative decisions remain accountable to the rule of law.
Why I Am Asking for Help
I am currently self-represented in this matter and have been personally covering the costs of the application to date. These expenses are ongoing and continue to accumulate.
Based on Ontario court fee regulations and related administrative costs, the estimated total cost is approximately $1,500–$1,800, including:
- Filing the application
- Preparing and perfecting the court record
- Affidavits, document preparation, and service
Transparency
I will provide updates on how funds are used, and can share receipts or supporting documentation where appropriate.
Use of Funds
Funds raised will be used exclusively for:
- Court filing fees
- Document preparation and copying
- Affidavits and commissioning
- Service and administrative costs
Closing
I am pursuing this matter through the appropriate legal channels, in accordance with the law. I am committed to seeing this process through thoroughly.
