Vrijheid van vestiging - Help mij verhuizen!

 

Hallo :). Mijn naam is Rhea en ik wil graag verhuizen naar een appartementje in een woongemeenschap in gemeente Berg en Dal. De gemeente heeft echter de aanvraag voor woningaanpassingen die ik als elektrische rolstoelgebruiker nodig heb afgewezen. Ik kan daar niet wonen zonder aanpassingen, dus vraag ik nu jullie financiële bijdrage om het zelf aan te passen en toch te kunnen verhuizen. Meer weten? Iets meer over mij: ik ben 33, speel piano (het liefst als straatmuzikant), deel video’s daarvan op mijn YouTube-kanaal, geef af en toe statistiekbijles en houd van capybara’s en andere cavia-achtigen. Door een auto-immuunaandoening uit mijn jeugd heb ik ernstige fysieke beperkingen en heb ik onder andere een elektrische rolstoel nodig. Voor de pandemie was ik maatschappelijk heel actief en nu probeer ik mij vanuit huis nog in te zetten voor allerlei kwesties.

Iedereen die mij kent zegt dat deze woongemeenschap echt een goede plek voor me zou zijn. De bewoners hebben mij in de zomer van 2021 al geselecteerd voor deze zelfstandige wooneenheid en ik ben inmiddels zelfs tot een van de algemene bestuursleden verkozen.

Ik wil daar graag wonen vanwege de gemeenschap, onderlinge betrokkenheid en toegankelijkheid (in mijn huidige straat, waar ik al ruim acht jaar woon, is geen van de huizen rolstoeltoegankelijk en kan ik dus nergens op bezoek). Daarnaast is er in het gebouw een pianovleugel, waar ik concerten hoop te organiseren. Het is dus als woning én als werkplek een vooruitgang voor mij.

 

Beperking van de vrijheid van vestiging

Het is niet alsof ik vraag om een boomhut toegankelijk te maken: het is een simpel appartement op de begane grond. Het gebouw heeft verder al een lift, dus ik kan ook gewoon op andere verdiepingen komen. Het is ook niet zo dat ik elk jaar wil verhuizen en telkens aanpassingen van de gemeente verwacht: ik woon nu al ruim acht jaar in mijn huidige appartement en hoop heel lang in de woongemeenschap te wonen. En voor de duidelijkheid: ik ga juist kleiner wonen (nog ruim genoeg voor mij met mijn elektrische rolstoel), dus de gemeente zou ook niet opeens aanpassingen aan te hoeven brengen in een luxe woning met drie badkamers of iets dergelijks.

Waarom gemeente Berg en Dal de aanpassingen toch nog niet heeft toegekend? Er zijn twee redenen:

1) twee gemeentes wijzen naar elkaar, waardoor mensen zoals ik tussen wal en schip vallen: omdat ik er nog niet ingeschreven sta, is men bij gemeente Berg en Dal van mening dat volgens de Wet Maatschappelijke Ondersteuning (WMO) de nieuwe gemeente de aanpassingen niet hoeft te verschaffen, maar dat ik met mijn aanvraag bij mijn huidige gemeente zou moeten zijn (werd mij ruim drie maanden na de aanvraag verteld). Mijn huidige gemeente, Nijmegen, is het daar niet mee eens.

2) ik woon al in een aangepaste woning en volgens de WMO-verordening zou ik daarom geen aanspraak kunnen maken op aanpassingen in een volgende woning, als ik net als andere mensen gewoon wil verhuizen. Dat betekent dat mensen met een beperking levenslang vastzitten aan dezelfde woning, tenzij ze zelf vermogen hebben.

 

Doordat ik beperkingen van gemeente Nijmegen opgelegd kreeg, kon ik daarnaast niet meer zelfstandig mijn muzikale activiteiten uitvoeren. Daardoor heb ik de afgelopen vijf jaar veel minder verdiend en nauwelijks hiervoor kunnen sparen. Ik mocht namelijk mijn mobiele piano (waarmee ik buiten in het centrum als straatpianist optrad) niet meer duwen met mijn elektrische rolstoel, die ik in bruikleen heb van de gemeente, terwijl dat makkelijk ging, zoals is te zien in onderstaande video. De gemeente heeft dat samen met de hulpmiddelenleverancier echter zonder onderzoek te willen doen verboden.

 

 

Allerlei procedures in de zorg zijn ook tijdrovend en Kafkaësk inefficiënt - afspraken met een tijdvak van zes uur voor reparaties aan mijn rolstoel die meer dan drie keer misgaan, aanvragen voor thuiszorg die herhaaldelijk worden afgewezen, enzovoorts - waardoor ik niet de zorg krijg die ik nodig heb en amper tijd en energie heb om ander werk, zoals bijles geven, te plannen (ik heb hierover ook een essay geschreven en daar heeft Omroep Gelderland een kort item van gemaakt, zie onderstaande video). Daarom is een deel van mijn crowdfunding ook voor de reguliere kosten van verhuizen en inrichten.

Iets meer dan € 10.000 is voor:

 

Het restant van circa € 6.000 is deels voor de reguliere kosten, zoals betegeling, gordijnen, andere inrichtingskosten en de verhuizing zelf. Deels gaat het ook om de kosten of gemiste inkomsten waar ik door deze vertraging mee te maken heb:

Ik had er rekening mee gehouden dat de procedure een paar maanden zou duren, maar had niet verwacht dat het zo'n langgerekt proces en touwtrekkerij van inmiddels negen maanden zou zijn.

Dit verhaal gaat zeker niet alleen om mij, maar om alle mensen die een aangepaste woning nodig hebben. De wet- en regelgeving heeft verbetering nodig. Het zou niet zo moeten zijn dat allerlei mensen met een beperking ook nog eens moeten gaan crowdfunden om de benodigde woningaanpassingen te krijgen of anders gewoon niet kunnen verhuizen.

Net als de meeste mensen hebben we te maken met krapte op de woningmarkt, net als voor velen is de betaalbaarheid voor mij een aandachtspunt, maar daarbovenop komen voor mij en andere mensen met een beperking de problemen dat er simpelweg te weinig aangepaste woningen zijn en gemeentes de benodigde aanpassingen voor andere woningen vaak niet toekennen.

Oorzaken zijn onder andere:

 

Dit alles is in strijd met het door Nederland geratificeerde VN verdrag voor de rechten van mensen met een beperking en het Protocol bij het Verdrag tot bescherming van de rechten van de mens en de fundamentele vrijheden (Protocol EVRM). Daarin staat dat burgers vrijelijk hun verblijfplaats mogen kiezen en dat mensen met een beperking dat op voet van gelijkheid met anderen ook mogen.

Deze veel voorkomende gang van zaken is vergelijkbaar met de Urgenda-rechtszaken, waarbij de overheid dus structureel beleid voert dat in strijd is met internationale verdragen die zij zelf heeft ondertekend.

 

Toekomstmuziek?

 

Met deze crowdfunding hoop ik dus mijn vrijheid tot vestiging te krijgen én aandacht te vragen voor de problematiek rond de Wet Maatschappelijke Ondersteuning en de Nederlandse zorgsector als geheel.

Alweer negen maanden geleden heb ik mijn aanvraag ingediend. Deze is in de herfst afgewezen en ik ben nu een bezwaarprocedure aan het doorlopen, waarvan mij door juristen is uitgelegd dat deze weinig kans van slagen heeft. Ondertussen moeten er binnenkort wel bedragen worden betaald aan de aannemer en andere leveranciers.

Mocht de gemeente na de bezwaarprocedure toch een deel van de aanpassingen toekennen en vergoeden, dan wil ik dat deel van de crowdfunding graag gebruiken om zelfstandig mijn muzikale werkzaamheden te kunnen hervatten, bijvoorbeeld met de aanschaf van een rolstoel in mijn eigendom, zodat ik wel zelf mijn straatpiano kan duwen. Een elektrische rolstoel met een onderhoudscontract kost ook minstens € 10.000. Maar dat is misschien meer toekomstmuziek.

Hello :). My name is Rhea and I'd like to move to an apartment in a cohousing community in "Berg en Dal" (Mount and Valley, a town nearby). However, the municipality has rejected my application for financial assistance for the special home modifications I need as a person who uses an electric wheelchair. Since I am not able to live there without those accommodations, I am asking your financial support so I can have the apartment modified myself and move there after all.

 

A bit more about me: I'm 33, play the piano (preferably as a street musician), share videos of that on my YouTube channel , tutor students in statistics from time to time and like capybaras and other cavy-like creatures. Due to an autoimmune condition I had in my childhood I have severe physical disabilities and among other things need an electric wheelchair. Prior to the pandemic, I was actively engaged in society and now I try to commit to several causes from home. 

Everyone who knows me says this cohousing community would be a good fit for me. The other residents have already selected me for this independent unit back in the summer of 2021 and more recently I was even elected to the general board. 

Reasons I'd really like to live there are the sense of community, involvement and improved accessibility (in my current street, where I moved to over eight years ago, none of the other homes are wheelchair accessible and consequently I can't visit any of my neighbors). 

Additionally, there is a grand piano in the building, so I hope to organize concerts there. Hence, it would be a better place for me to live as well as work.

Restriction of the freedom of movement and residence 

It's not like I'm asking the municipality to make a tree house wheelchair accessible: it's a simple apartment on the ground floor. Furthermore, there is an elevator in the building, so I can easily access the other floors (in contrast to my current building).

It's also not the case that I have been or plan on moving every year and expect the municipality to keep providing financial assistance for the special modifications: I've been living in my current place for over eight years and hope to be part of the cohousing community for a long time. And to be clear: I'm moving to a smaller apartment (still spacious enough for me with my electric wheelchair), so this is not a step for luxury.

Why the municipality of "Berg en Dal" nevertheless has still not granted me the adaptations? There are two reasons:

1) two municipalities are pointing to each other to take legal and financial responsibility, effectively causing people like me to fall through the cracks: because I am not yet a registered resident of "Berg en Dal", they claim the law states the new municipality does not have to provide the adaptations and I should apply for them with my current municipality (which they told me over three months after I filed my application). My current municipality, Nijmegen, does not agree. 

2) I already live in an adapted apartment and according to the laws and regulations, I would not be eligible for assistance for my next home, if my reason for moving is that I simply wish to live somewhere else, like other people without disabilities do from time to time. That means people with disabilities have to spend a lifetime in the same house and neighborhood, unless they have quite some financial means to make the necessary adaptations themselves.

In addition, due to restrictions imposed on me by the municipality of Nijmegen, I haven't been able to carry out my piano related activities independently. Because of that, I have earned much less over the past five years and could hardly save up for this. The story behind this is I used to perform on my mobile piano in the streets of the city center, as a street musician or "busker". You have to change to another spot every thirty minutes and to do so, I used to push my mobile piano with my wheelchair, which was quite easy, as you can see in the video below. However, the municipality has forbidden me to continue doing that with my wheelchair, which they lend to me. This prohibition was imposed by them (and the wheelchair supplier contracted by them) without any willingness to look into the possibilities with an actual investigation into the technical side of things, while it was so important to me for my life and livelihood. As I state in the final section of this text, I hope to purchase my own wheelchair in the future, so I can work as a street pianist again. 

Furthermore, various facets of the health care sector are time-consuming and inefficient to a kafkaesque degree - appointments to repair my wheelchair that are planned in six-hour time frames, only to fail or fall through more than three times, applications for care at home getting rejected repeatedly, etcetera - which means I don't get the care I require and barely have any time and energy left to plan other work, like tutoring statistics (I also wrote a Dutch essay about this and the local broadcasting station Omroep Gelderland made a short item about that, see the video below). That is why a part of my crowdfunding is also to cover the regular costs of moving and furnishing.

 

The financial picture

Approximately € 10.000 is for:

- the additional costs of an adapted kitchen (lower, a special faucet and the like),

- adaptations in the bathroom

- an automated door in the building's entry hall 

- special extended levers to open the windows myself 

The remaining € 6.000 consists in part of the regular costs, such as tiling, curtains, other furnishing costs and moving. In part it concerns costs or lost income I'm faced with because of the delay:

- the rent of my new apartment is lower than my current rent, but because I can't live there yet and have to stay in my current place, I still have higher monthly housing costs

- soon, I will also have to start paying double rent

- all the hours I have (had) to spend on the (appeal) procedures with the municipalities of "Berg en Dal" and Nijmegen can't be spent on work, which means I earn less income 

The bigger picture

I had anticipated that the procedure would take several months, but hadn't expected it to be such a lengthy and arduous process lasting already nine months now.

This story is not just about me, but about all people who need special accommodations in their home. The laws and regulations need reforms. People with disabilities shouldn't have to start crowdfunding to obtain the necessary home modifications or be unable to move at all otherwise. 

Just like most people we are faced with the general housing shortage, just like many people affordability is an issue for me, but on top of that, another problem arises for me and other people with disabilities, i.e. that municipalities are often unwilling to grant financial support to make a new place accessible, even though accessible homes are even more scarce than affordable housing in general. 

Underlying causes include:

- With the decentralization in 2015, the central government has given municipalities many more tasks within the Social Support Act (Wet Maatschappelijke Ondersteuning, WMO), but not the necessary financial resources to fulfill those responsibilities

- the WMO does not properly describe which municipality is responsible for adaptations in a new home if someone moves to another municipality, so that municipalities (with their limited budgets) can start referring to each other and citizens in need of care are sent from pillar to post and ultimately fall through the cracks

- the WMO indicates that someone is only eligible to receive assistance if it is necessary to move 

All of this is in violation of the UN Convention on the Rights of Persons with Disabilities and Protocol 4 of the European Convention on Human Rights and Fundamental Freedoms (Protocol ECHR). These conventions state that all citizens should have the opportunity to choose their place of residence and where and with whom they live and that persons with disabilities should be free to do so as well, on an equal basis with others.

This common course of action is similar in form to the events that led up to the Urgenda Climate Cases, where the Dutch government implemented and continued policies which were in violation with international treaties that had been signed.

Wishful thinking?

With this crowdfunding campaign, I hope to gain my freedom of movement and residence and to raise awareness about the issues surrounding the Social Support Act (WMO) and the Dutch healthcare sector in general.

I submitted my application for assistance over nine months ago. It was rejected in the autumn and I am now awaiting an appeal procedure and deliberations between lawyers of both municipalities. In the meantime, invoices from the contractor and other suppliers will be due soon.

If the municipality does in the end grant and reimburse part of the modification costs after the appeal procedure, I would like to use that part of the crowdfunding amount raised to resume my musical activities independently, for example by purchasing a wheelchair of my own, so that I can drive my street piano myself. An electric wheelchair with a maintenance contract would cost at least €10,000 as well. But perhaps that is wishful thinking.
