EPADI II - Vascepa Intellectual Property Justice Fund - Appeal
On May 21, 2021, the EPA Drug Initiative II (EPADI II) filed an Appeal with the Federal Circuit Court in Washington D.C. to contest the April 30, 2021, decision issued by Judge Miranda Du in the U.S. District Court in Nevada. The Appeal has asked the Federal Circuit Court not only for reversal on the Rule 24 Standing issue, but to also exercise its authority to enter Judgment on the Rule 60 that Judge Du failed to address in her April decision.
Once the Appeal is docketed, the Court will advise EPADI II of the additional documentary requirements as well as a briefing schedule. We will then file the opening Brief, our adversaries will be given time to respond, and then EPADI II will file a Reply.
While EPADI II has received a very generous donation from one of its members in support of this initiative, additional funds are necessary to undertake this effort with a reasonable expectation of a desirable outcome. Therefore, EPADI II is seeking an additional $8000 from the public to support this effort. This amount would be used to cover several expenses in the appeal process to include a filing fee of $505.00, approximately $1000 - $1500 in copying/binding fees, and the commission charged for fund raising, with the balance of the funds raised to cover attorney time on the Brief, Reply Brief, preparation of Appendices, potential oral argument preparation, and attendance (via phone or ZOOM). Additional funds may be sought in the future should travel to D.C. be necessary to present the case in person before the Federal Circuit (unexpected), or in the event the case is remanded by the Federal Circuit Court back to the Nevada Court.
