Healthy Environment: Healthy Life-No Incineration

This campaign is to benefit the residents of Endicott NY  and surrounding communities who will be subject to significant health and safety risks from incineration of lithium-ion battery parts. 

Unconscionable Action
At a meeting on May 7, 2020, held online, in the midst of the greatest, worldwide pandemic in 100 years, the Village of Endicott Board of Trustees adopted a zoning amendment that allows incineration of battery parts in a facility located in the heart of the village. The facility is next to homes, Little League fields, and near the community swimming pool, merry-go-round, and preschools.

Opposition by Hundreds
Even with tremendous public opposition by hundreds of people, from residents to state senators to school boards to environmentalist groups, and a formal protest petition submitted to the Village Board, the zoning change was still adopted by the Board, 3-2, on September 21, 2020.

Severe Repercussions
This zoning change now allows a process where many very toxic substances are formed and released during the heating and burning process, including hydrogen fluoride, dioxin, at least 4 known carcinogens, nanoparticles, and possibly PFAS (per- and poly- fluoroalkyl substances). The current cancer rate in Endicott is already very high due to pollution from TCE spills by IBM in the 1970s.

Failure to Protect Residents
The Village Board failed to protect the residents as it did not require an environmental assessment that should have taken place for a proposal such as this that has the potential to result in significant adverse environmental impacts.

Legal Action
As a result, an Article 78 lawsuit  has been served against the Village. Legal actions against organizations like this are expensive and can be lengthy. We are requesting donations to support a legal fund that will be used to assist with this action only.  The firm we are using is Braymer Law PLLC , who specializes in environmental law.
