Hi everyone, My name is Roz and truthfully it was hard for me to make this page. Its always been hard for me to ask for help, but there is a time to swallow pride and today is that day. So where do I begin..... About 10 months ago my 16-year-old son, noticed some water on the floor in his room. At the time he thought it was his two younger brothers spilling or dumping liquid in the trash. After it happened two times I did some investigating. Turns out there was water coming thru the walls. When I took a closer look behind his bed I noticed fungus growing out of the walls. Actual mushrooms were growing out of the baseboards near the floor. I immediately took photos and sent them to my Home Owners Association because I was sure that the water was coming from an upstairs unit and not our home. It took the HOA 2 weeks to send someone to look at the mold, after repetitive emails and calls. When a mold specialist finally came they did confirm that the water and mold were caused by an upstairs leak and unit. They sent all this info back to my HOA. After that, it took months for them to get the work approved. I didn't think to contact my insurance because I knew it was not coming from our home and in the past, the HOA had handled any outside issues. Long story short they tore open my wall and cleaned out the mold leading us to believe that the cost would be handled. Weeks after they opened my wall and cleaned the mold, We get a letter from the HOA that the insurance that we paid for with our monthly dues was not going to handle the cost. Their reason was stated, That the mold was not reported in a timely fashion. This is bs because I reported it as soon as I saw it! They then stuck us with a bill of 4500 dollars that included, demolition, mold specialists, all the work, plummer etc, and never fixed the hole in the wall. I had to find a local handyman to fix my wall for me because my HOA refused to fix it. Now my HOA is fighting me to pay the 4500 dollars for all work including late fees. I'm having a hard time working with my home insurance to cover the cost of damages, time and repairs. I am asking for help from my community, because the Lawyer that represents my HOA is a really unreasonable horrid human, and he has already attempted to and succeeded in suing us for late HOA fees of which we are in a current chapter 13 to pay back. If he decides to come for us over these ridiculous charges it could affect our current status and put us in danger of defaulting on our current chp13 order and risk foreclosure. My husband and I are use to working hard to handle these situations on our own but at this time we are just spread too thin with a time-sensitive situation. Things have been rough for a while and for those of us who know us, we always try and help those in need. This time around we humbly need a little help from the community to insure our home is protected for our boys and ourselves. Also, we are going to be pursuing legal counsel and action against our HOA because of this whole situation. This was hard for me to write so please forgive me if I made mistakes in grammar.
