Court costs for falsely accused

Hi all,

I am fundraising on behalf of my uncle.

My uncle is ex-army and trained the police force for many years, he is now in his 60’s with a condition called IPF which has no known cure we have also recently found out that he has lung cancer, as you can imagine this has been a huge strain on him and our family as a whole.

my uncle now supports vulnerable adults overnight and felt a colleague had left the service unsafe and was falsifying documentation by leaving his shift early, completing and preempting documentation regarding vulnerable adults for the time whilst he was not there and also claiming the hours he left early via payroll. My uncle has raised issues following correct policy and procedure, also safeguarding concerns to management to which had no management support and the issues persist.

my uncle is now suspended from work as he asked his colleague to change his sign out time due to him not being on shift when he arrived and leaving a service unsafe, during this his colleague became irate.

This has then led to a false allegation of racially aggravated assault against my uncle and his colleague has now reported this to the police. As you can imagine with his health needs and current situation of a very recent cancer diagnosis my uncle would not physically be able to assault anyone, he also had a medical examination to back this up less than 24 hours after the alleged assault to which his GP has written a report stating he had no injuries or markings on himself inline with any assault toward him or from him.

As my uncle has done nothing wrong he has voluntarily been questioned by the police and has now received a letter for a “plea hearing” at magistrates court.

this is a huge expense as my uncle is not currently entitled to legal aid. As you can imagine this has had a huge impact on my uncle and my family. My uncle is suffering with mental health and has just had a huge life threatening operation to have part of his lung removed due to his cancer diagnosis.

At this point it looks like he will have to self represent at court, whilst the gentleman who has falsely accused him is being given government help even though working full time. There were no witnesses to the alleged assault and is one word against another.

If we cannot raise funds to ensure my uncle has a fair time in court there is potential us as a family will not get extremely important time with him and he will not have access to the correct treatment if convicted due to his IPF being such a specialised condition there are limited consultants in the country whom can deal with this, that’s without his cancer treatment aswell.

any funds raised will be used to pay court fees and legal costs to ensure my uncle gets the justice he deserves and his name cleared from a very serious but false allegation.
