Who could have expected that this legal process could take so long!
Just wanted to let everyone know that David's new legal proceedings to clear his name have finally started! The discovery process, which began a few months ago, has kicked into high gear. Earlier this week, David--as well as one of the defendants--was deposed. Other depositions are happening next week. All these depositions add up to legal fees, and any support you can give to David is appreciated. (All donations through this site go directly to him.)
UPDATE #2:
On behalf of David and his family, we can’t thank all of you enough for the unwavering support and for standing up against the unjust treatment of this incredible teacher and mentor. The road has been long and the process has still not yet ended.
First, a bit of an update. After what seemed like an exceptionally and unexpectedly long time, David received a ruling from the judge on September 18; however, the ruling did not make sense, and David was left wondering what to do next. For that reason, we did not provide any updates on this site, because we did not feel that there was anything meaningful to say. After discussions with David, on November 5, his lawyer filed a “Memorandum of Law in Support of Petitioner’s Motion for Leave to Reargue and Position Statement.” This document clarified where David and his lawyer felt the judge had not addressed key issues, cited about 50 previous cases to back up their statements, and also requested very specific forms of relief.
Surprisingly, within a few days the judge wrote back and scheduled another hearing for David in mid-December.
Since the start of this ordeal in March of 2018, David has exhausted all of the money raised through GoFundMe on legal fees, as well as about $10,000 that included his own funds and funds raised outside of GoFundMe. This case is truly a David-and-Goliath scenario, because the Goliath in this situation has access to public funds that total nearly $1.8 million annually--money provided by New York State taxpayers. David does not have access to such funds. And, because of the defamatory articles that have appeared in the Ithaca Times, he has been unsuccessful at finding employment and has been out of work since April.
As a result of his enormous legal expenses, David was forced to relinquish his apartment in Ithaca, the area he came to love, and where he planned to make his home for many years. He had to leave his friends, students, fellow musicians, and several ongoing musical projects. Tragically, Ithaca lost a dedicated and outstanding performer and educator who helped his students grow and thrive as musicians, and helped them become responsible young adults. David has now relocated to live with his family where he continues the battle.
We have every confidence that David will prevail if he can continue to disprove the baseless, defamatory allegations that have been thrown at him, and expose the truth of the situation. But he needs our continued support. Every donation you can provide will help ensure that truth and justice will prevail, and is a blessing to David.
