For over a year and nine months, The California Department of Public Health (CDPH), The California Department of Education (CDPE), The Los Angeles County Department of Public Health (LACDP), and local school districts, including but not limited to, PVPUSD, forced children into a year of home isolation, mandatory public mask guidelines, COVID-19 testing and now they are forcing the children to get an Emergency Use Authorized vaccine, or the children will lose access again to in-person education.
Schools received millions of dollars in award money to employ rapid routine asymptomatic testing for exposure to the SARS-CoV-2 virus as part of the State's Promotional Strategy to vaccinate all of the children. Schools also received millions of dollars to upgrade their classrooms' ventilation systems. However, many Public Schools and Businesses failed to do their most basic ministerial duties of providing clean air.
Since 1946, The Administrative Procedure Act (APA) has protected Americans from any requirements that may cause serious harm to the public peace, health, safety, and general welfare. It is one of the most important pieces of United States Administrative Law to ensure that Government Agencies do not abuse their power.
CDPH, CDPE, LACDP, and PVPUSD failed to follow the Administrative Procedure Act, and they have abused the children by forcing children to carry an undue burden.
According to experts in Industrial Hygiene, The CDC, The National Institute of Occupational Safety, OSHA, and other experts, the most effective strategy for reducing airborne viruses is to improve ventilation in the buildings. Delivering between 6 and 12 air changes per hour of outside or clean air can significantly reduce the spread of airborne infectious diseases by 99%, making the threat of COVID-19 insignificant when the air quality, circulation, and ventilation system is excellent.
Instead of following the highest hierarchy of scientific control measures, Schools went with the cheaper and less effective mitigation strategy. They relied on controlling children's air by forcing children to keep their nose and mouth covered at all times, even though PPE offers marginal protection. Studies demonstrate that the average viral penetration through a typical non-surgical face mask is 74% to 90% - leaving a child not only exposed to a significant viral load, but at the end of a school day, children have a wet mask and are unable to exhale (ventilate) fully.
The Parents of Save PV Schools, LLC are deeply concerned about the safety and well-being of all children. They want to stop the above Government entities from exceeding their lawful authority.
They retained the Legal Counsel of Matthew Harrison of Prometheus Civic Law to file a Writ Of Mandate against PVPUSD and the other mentioned Government Entities. They are raising money for their Legal Case to ensure that those with Administrative Powers follow the proper procedures. Amongst their many lists of Legal Demands is that The Schools Create an environment so that our children have safe air to breathe. And, most importantly it is the mission of Save PV Schools, LLC to ensure that all children are granted the human dignity of choice to show their smiles at school once again.
