Yaherb Cannabis Cafe Nelson BC is asking for your help in raising $5600 to retain the talents of Cannabis Lawyers and Activists Jack Llyod and Kirk Tousaw.
After years of activism and hard work Yaherb Cannabis Culture Cafe in downtown Nelson Bc was denied a permit to open by Nelson City Council.
We feel this decision was not reasonable and sets back British Columbia's move towards legal cannabis consumption spaces.
With your donation we can have Jack and Kirk review the decision and consider an appeal to the BC Supreme Court.
We would also have their support to reapply with new information or from a new location.
This work will help provide clarity for our business as well as anyone else considering cannabis consumption locations in British Columbia.
In 2024 the Province permitted cannabis consumption spaces to open subject to local government bylaws.
Nelson has a zoning bylaw that prevents all “cannabis operations” from all zones including the downtown commercial zone. Cannabis operations includes all forms of cannabis consumption.
Yaherb Culture Cafe began to work with Nelson’s City Development Services Department in November 2024.
We worked hard to prepare our application and were happy to have the Development Services Department Staff recommend that City Council approve the permit.
But it was not to be.
On May 6 City Council immediately moved to deny the application. The discussion was awful and not reasonable.
The denial has set back cannabis consumption spaces in BC and resulted in financial hardship for Yaherb Cannabis Culture Cafe.
