Thank you to Julio Cesar's family and all of the community supporters who came out today and PACKED IJ Nelson's courtroom today.  Together, WE WON!  This win means that after living in San Jose, California for his entire adult life, Julio Cesar will not be deported to a country where he hasn't lived in for 20 years and where he fears torture.  It also means that he will be able to see his four little children again after over six months of immigration prison and maybe even attend his son's wedding in two weeks.    

As we've seen before, the government attorney provided no evidence at all other than a long narrative based on false information and Julio Cesar's withholding of removal denial. Despite this, the government attorney reserved appeal.  If the government actually files the appeal, it would prevent Julio Cesar from paying bond and being released.  This means that Julio Cesar needs to pay the $10,000 bond ASAP.  

On May 11th, Julio Cesar's oldest son will be getting married. Julio Cesar's wish is to be reunited with his family, who has struggled tremendously since he was detained, and to be able to witness his son walk down the aisle to say, "I Do," to his fiancé.

Julio Cesar is a 39-year-old father of 4 US citizen children and has been a San Jose resident for over 20 years. On October 23, 2018, as Julio Cesar was taking his 6-year-old daughter to school, ICE agents rushed to his vehicle and drew weapons on Julio Cesar and his daughter. ICE apprehended Julio Cesar without a care that a child was in the car, who witnessed the cruel aggression used against her father.  Coincidentally, two days before being apprehended, Julio Cesar proactively went to the San Jose Police Department to inquire about a traffic ticket he never received in the mail. Julio Cesar recalls that SJPD officers scanned his driver license before giving him further information on how to proceed paying his traffic ticket. Community members and organizations have reason to believe that the San Jose Police Department shared his information with ICE, violating Santa Clara County’s sanctuary policy and violating SB 54, “California Values Act.”  These past 6 months have been incredibly difficult, emotionally and financially, for Julio Cesar and his family.  Most recently, Julio Cesar’s family lost their home and are now living in Sunnyvale with his sister. Julio Cesar tells his legal team, “I do not even know where I live anymore, and it breaks my heart that my family has to go through this nightmare while I am separated from them.”  The family has had to let go of their family truck - the same truck that Julio Cesar used to pick up goods around the neighborhood in San Jose to donate to the local Salvation Army.  Julio Cesar’s family has been struggling tremendously without him, his children’s school grades have significantly dropped because of his absence because Julio Cesar plays a large role in his children’s academic life. His 10-year old daughter has been experiencing deep sadness and has referenced loss of appetite due to her family being broken apart. Additionally, Julio’s 18-year-old son has put his education on pause to help his mother financially; he aspires to become an engineer.


5/3/2019: The funds from this campaign will be withdrawn by Maria Alvarado Leyva, Julio Cesar's wife.  Before launching this campaign, we received verbal confirmation from both Julio Cesar and Maria that Maria will withdraw the funds to help pay Julio Cesar's bond/personal loan used to pay bond.
