The Committee to Save Academic Integrity Now (SAIN) was formed to educate faculty about a problem with New York State law that is often used to prevent faculty from enforcing their rights. We are raising money to overturn a recent court decision which could impact faculty in every academic institution in New York State.
In 2014, two tenured research scientists at NYU's School of Medicine ("SOM") sued after NYU's administration reduced their salaries solely because they did not secure enough grant money for NYU. This despite the fact that NYU's Faculty Handbook states that tenure guarantees both academic freedom and economic security. In response to the lawsuit, NYU's lawyers argued that the case should be thrown out because the handbook is not an enforceable contract. According to NYU's lawyers, even ifNYU had violated the handbook, the faculty members had no right to sue because NYU is not contractually obligated to comply with its own policies. Unfortunately, the court agreed and dismissed the case. This is a bad decision and an appeal has been filed,
