A fraudulent inducement claim is a legal action filed when a person is tricked into a contract based on intentional lies, false promises, or concealed information from the other party. To succeed, the claimant must prove the other party made a false statement about a material fact, knew it was false or acted with reckless disregard for the truth, intended to deceive, and the claimant justifiably relied on this misrepresentation, resulting in damages. If successful, the claimant can seek to have the contract voided and recover financial damages.
This is what I am going to have to sue my brother's estate for, but that is going to be costly. How is fraud the responsibility of the victim? My brother approached me with a beautiful offer to set up a trust for his daughter ( who I wanted to have my home upon my death) and leasing it to me for 150.00 for the remainder of my life. But he signed my house over to his daughter 2 months before he died and without the trust filed or lease in place that he offered me in getting me to give up my deed. South Carolina Legal Services said this is hard to prove. What they really meant is it's complicated and they don't have the funds for complicated cases. And this case isn't about money it's about me getting my deed back . My brother offered me something wonderful and instead created trauma. Justice shouldn't cost so much but, sadly it does.
This is why I am starting a GoFundMe because at nearly 71, to lose my home and equity based on a lie is crazy.
