My sister describes this whole ordeal as an "Adirondack David and Goliath" story..... and it is with abject humility that I turn to this platform. But, I am desperate and really don't have any other choice.
I've been fighting a Legal battle (pro-se) for two years with the people who bought my brother's property. The man is an attorney himself and has had the town attorney as his lawyer since purchasing my brother's piece of the subdivision. In lieu of any due diligence, they chose to set their own course for the ROW through MY property’s ONLY BUILDING SITE. I should mention here that I have an Express Deed which allows for its relocation. I had the access road built, surveyed, and submitted all documents to easement holder's for approval.
The other two Lot owners promptly granted their approvals but "they" unreasonably withhold theirs, while further encroaching on my property with the installation of their electric.
Why?
Because they want a straight driveway.
All of this..... because they want a straight driveway.
They could care less if it impacts the value of my lot as a home.
You would think that as a property owner, I would have the right to defend my property, but it is only through the costly legal system that I can stop them (local police say a civil matter after receiving call from town's attorney.)
The amount of property destruction is not to be believed, and has continued for as long as they have drawn this out.
I've stumbled through the legal system for two years, and recently filed a motion to quiet title. They filed a cross motion to dismiss.
I am now in over my head with this legal paperwork, and its too important to risk screwing it up now. It's so close to finally being over but, I need professional help and the attorney I spoke with wants a five thousand dollar retainer. I have spent all I had (thirteen thousand) and I can't work hard enough to come up with it before paperwork is due to the court (June 28th).
